HomeMy WebLinkAbout98-413 INDEXED . ,._. _. , ? ?c~::.~_ ~r, 3220 PG OFFICIAL RECOROS OF IIOHAVE COUNTY~ AZ .DOAN MC CALL~ MOHAVE COLINTY 12/'2411~8 ll:08A PAGE 1 OF ~OH~VE COUNTY BOARD OF SUPERVISORS RECORDIHG FEE RESOLUTION NO. 98-413 A RESOLUTION SETTING FORTH THE APPROVAL OF AN AMENDMENT TO THE MOHAVE COUNTY GENERAL PLAN, TO AMEND THE LAND USE DESIGNATION OF A PORTION OF SECTION 19, TOWNSHIP 20 NORTH, RANGE 17 WEST, EXCLUDING THE ARIZONA STATE TRUST LAND WEST OF INTERSTATE 40, FROM SUBURBAN DEVELOPMENT AREA TO URBAN DEVELOPMENT AREA, HEAVY INDUSTRIAL; AND TO AMEND THE LAND USE DESIGNATION FOR THOSE PORTIONS OF SECTION 19, EXCLUDING THE ARIZONA STATE TRUST LAND WEST OF INTERSTATE 40, AND SECTIONS 30 AND 31 OF TOWNSHIP 20 NORTH, RANGE 17 WEST, AND SECTION 6 OF TOWNSHIP 19 NORTH, RANGE 17 WEST, LYING WEST OF THE INTERSTATE 40 RIGHT-OF-WAY, FROM RURAL DEVELOPMENT AREA TO URBAN DEVELOPMENT AREA, HEAVY INDUSTRIAL; AND TO DESIGNATE THE EXISTING URBAN DEVELOPMENT AREA IN SECTION 7, TOWNSHIP 19 NORTH, RANGE 17 WEST, AND SECTIONS 12, 13, AND THE N¼ OF SECTION 14, TOWNSHIP 19 NORTH, RANGE 18 WEST, AS HEAVY INDUSTRIAL, AS DEPICTED ON EXHIBIT A, AND TO AMEND EXHIBIT VI.8 OF THE GENERAL PLAN TO MATCH, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on December 21, 1998, a public hearing was conducted to determine whether approval should be granted to amend the Mohave County General Plan, designating the above-described property as an Urban Development Area, Heavy Industrial, as requested by the Mohave County Economic Development Authority, Inc., of Kingman, Arizona, representing the property owners: Western Progress Company of Litchfield Park, Arizona, First American Title Insurance Company, Trusts 7794 and 4446, of Phoenix, Arizona, and June D. Jarvis of Santa Monica, California, and WHEREAS, these properties are located west of the Interstate 40/Griffith Road intersection and along the west side of Interstate 40 north of Griffith Road. All sections are accessed from Interstate 40 via west on Griffith Road to Apache Road. The property is vacant and the terrain is relatively flat, sloping slightly to the southwest. The Griffith Wash and Shingle Canyon Creek (ephemeral) traverse Sections 30 and 31. Section 6 is also crossed by a significant but unnamed wash. The surrounding land uses consist of vacant land, a few scattered single-family residences, and the Praxair plant at the Griffith Interchange, and WHEREAS, the current, revised Mohave County General Plan was adopted on March 10, 1995, and has been amended twice since then. The applicant requests this General Plan Amendment change to allow for future industrial development. The Mohave County General Plan presently designates this area as a Rural Development Area and the northwest portion as a Suburban Development Area. The property is presently covered under Citizens Utilities Rural Company franch/se for electric and telephone service. The site does not fall within a fire district boundary. The Golden Valley Fire Department has concerns over the lack of fire protection in the area, and ?AGE 2 OF' BK ~220 F'G 37;~ FEE~-98077742 RESOLUTION NO. 98-413 Page 2 WHEREAS, the Bureau of Land Management (BLM) objects to the General Plan amendment because it is not consistent with the Kingman Resource Management Plan, adopted in 1996. The BLM suggests that before a revision to the General Plan is processed, a "study should [be done to] look at the 1-40 corridor project as a whole and include determinations on the impacts to the Goals of the Mohave County General Plan," and WHEREAS, a review of FEMA FIRM Panel #040058-2325B and #040058-2500B indicates that a portion of the parcels described are in Zone A, in the Special Flood Hazard Area, and that a portion of the parcels described are in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. Approximately 600 notification letters were mailed to individual property owners within a one-mile radius of the subject properties. b. A public meeting was held on August 20, 1998, at the Mohave County Board of Supervisors meeting room, located in Kingman, where 15 members of the public were present. c. The proposed action and the effect complies with the Mohave County General Plan as follows: i) Policies 15.1, 15.2, 15.3, relating to the transition from RDA to UDA designations. ii) Policies 19.1, 19.2, 19.3, relating to the transition from SDA to UDA designations. iii) Policy 21,6, in locating industrial development with easy access to the various airports in Mohave County. iv) Policy 21.8, concerning the protection of industrial areas from residential encroachment. v) Policies 36.2, 36.6, 36.7, 36.9, regarding the creation of a diverse and stable industrial base. vi) Policy 37.1, providing for economic development in appropriate places in the county. d. The proposed action and the effect complies with the Mohave County Economic Development Plan. e. The site is adequate for the action intended and the use will be consistent with the surrounding terrain and the existing industry to the south. f. The southwestern boundary of the site adjoins an existing Urban Development Area in Section 7. g. The site has legal access. h. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Areas. WItEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1998, the Commission reconunended APPROVAL for the Amendment subject to the following: F'~6E 3; OF 4 BK :$220 F'6 3'94 FEE~98077762 RESOLUTION NO. 98-413 Page 3 1. Section 19, Township 20 North, Range 17 West, excluding the Arizona State Trust Land west of Interstate 40, will be amended from a Suburban Development Area to an Urban Development Ama, Heavy Industrial; and the land use designation for those portions of Section 19, excluding the Arizona State Trust Land west of Interstate 40, and Sections 30 and 31 of Township 20 North, Range 17 West, and Section 6 of Township 19 North, Range 17 West, lying west of the Interstate 40 right-of-way, will be amended from a Rural Development Area to an Urban Development Area, Heavy Industrial; and to designate the existing Urban Development Area in Section 7, Township 19 North, Range 17 West and Sections 12, 13 and the NIA of Section 14, Township 19 North, Range 18 West as Heavy Industrial, as depicted on Exhibit A, and to amend Exhibit VI.8 of the General Plan to match. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 2, 1998 and posted December 4, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
