WHEREAS, the Board of Supervisors has received a request from the Presiding Judge of
the Mohave County Superior Court for an allocation of contingency funds for FY 1998-1999 for the
purpose of employing a Persormel Officer and Office Assistant Senior with the Superior Court; and
WHEREAS, it is the desire of the Board of Supervisors to carefully and thoroughly consider
this request and to examine alternative approaches for addressing the perceived needs of the Superior
Court within the County's current budget and administrative structure; and
WHEREAS, the Board has retained the law firm of Mariscal, Weeks, Mclntyre &
Friedlander, P.A. as special counsel to the Board, for purposes of providing advice to the Board with
respect to the Presiding Judge's request and taking such other actions with respect to the subject
matter of that request as the Board may, from time to time, authorize and direct.
NOW, THEREFORE, the Board resolves as follows:
1. The Board requests that Mariscal, Weeks, Mclntyre & Friedlander, P.A. conduct
such research and engage in such other activities as may be necessary to fully advise
the Board regarding its rights and responsibilities with respect to the Presiding
Judge's request and to further investigate approaches for addressing the perceived
needs of the Superior Court within the County's current budget and administrative
structure;
2. The Board directs the County Manager to take such actions as may be necessary to
assist Mariscal, Weeks, McIntyre & Friedlander, P.A. in the performance of its work;
3. Mariscal, Weeks, Mclntyre & Friedlander, P.A., in conjunction with the County
Manager, is directed to enter into discussions with representatives of the Superior
Court in an effort to identify alternative approaches for addressing the perceived
needs of the Superior Court within the County's current budget and administrative
structure;
4. Mariscal, Weeks, McIntyre & Friedlander, P.A. and the County Manager are directed
to utilize their best efforts to complete their investigation and discussions, and to
report to the Board with respect thereto, by or before December 3, 1998.
5. Further consideration of the Presiding Judge's request shall be deferred until the
Board meeting currently scheduled for December 7, 1998, or as soon thereafter as
reasonably practicable.
PASSED, APPROVED AND ADOPTED this 2nd day of November, 1998.
