AZ JOAN MC CAEL, MOHAVE COUNTY RECORDER 12/08/1~98 03:~2P PAGE i OF 2 RECORDING FEE RESOLUTION NO. 98-433 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 7, BLOCK 2, MOHAVE VALLEY BUSINESS PARK, TRACT 4029-A, IN SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR AN OFF-PREMISE SIGN IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1998, a public hearing was conducted to detemaine whether a Zoning Use Permit should be granted for the above-described property as requested by Martin Media of Fort Mohave, Arizona, being represented by C.S.N.A. Surveying of Kingman, Arizona. The property owners are Stephan M. and Shirley A. Valihora of Bullhead City, Arizona, and WHEREAS, this property is located on the east side of State Highway 95, between Camp Mohave Road and E1 Rodeo Road. The site is accessed from State Highway 95 via east on Courtney Place to the site, located on the northeast comer of Courtney Place and the State Highway 95 Frontage Road. The property has an automobile repair business on it mad the terrain is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of other general commercial businesses and a few vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an off-premise sign in a C-2H (General Commemial Highway Frontage) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. The nearest off-premise signs are 0.5 mile to the north and 0.6 mile to the south. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. F'~G~ 2 OF 2 RESOLUTION NO. 98-433 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on November 12, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for an off-premise sign in a C-2H (General Commercial Highway Frontage) zone and activities related thereto. The maximum sign area is two hundred fifty (250) square feet and a maximum height of thirty-five (35) feet above the grade of the highway. 2. The applicant shall obtain the proper Arizona Department of Transportations (ADOT) permit and approval prior to erecting this sign and meet the proper spacing and distance requirements. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not conm~enced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 18, 1998, and posted on November 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
