WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolution for the Zoning Use Permit for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owner is Andrew A. and Elouise E. Banks, Mohave Valley, Arizona, and WHEREAS, this property is located on the west side of State Highway 95, between Hammer Road mad Torrance Road. The site is accessed directly from State Highway 95 to the west. The property has a commercial building on it and the terrain is relatively flat, sloping slightly to the west toward the Colorado River. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a Zoning Use Permit for a night watchman's quarters by the Mohave County Board of Supervisors on July 17, 1995, via BOS Resolution No. 95-273. There were not may Extensions of Time requested by the property owner. A letter dated August 27, 1998, had been sent to the owner notifying them that their approval of their Zoning Use Permit has expired and an Extension of Time was required. The property owner called on September 3, 1998, informing the Planning and Zoning Department that the trailer had been removed and the use is discontinued. Another letter was sent informing the property owner that it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on November 12, 1998, the Commission reconmaended that BOS Resolution No. 95-273 be RESCINDED. RESOLUTION NO. 98-435 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 18, 1998, and posted on November 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1998, RESCINDED BOS Resolution No. 95-273, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
