HomeMy WebLinkAbout98-438 OFFICIAL RECORDS OF MOHAVE COUIqT'f'~ JOAN M£: CALLs MOHAVE COUNTY MOHAVE COUNTY B, OARD OF SUF'ERV]:SORS RECORDING FEE RESOLUTION NO. 98-438 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 90-320 WHICH APPROVED THE REZONE FOR THE S~ SE'/4 NE¼ OF SECTION 14, IN TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolution for the Rezone for the above-described property as requested by the Mohave County Planning and Zoning Department. The current property owners are Nancy Schaffer, Trustee, of Anaheim, Califomia, and Edward A. and Dorothy Higgins of Kingman, Arizona, and WHEREAS, tiffs property is located south of State Highway 68, between Bacobi Road and Aztec Road. The site is accessed from State Highway 68 via south on Bacobi to the site, located on the southwest comer of Bacobi Road and Miran~ar Drive. The west half of the property has a single-family residence on it and the east half is vacant. The terrain is relatively flat, sloping slightly to the southwest. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to A-R/4A and A-R/2A (Agricultural-Residential/Four Acre and Two Acre Minimum Lot Size) by the Mohave County Board of Supervisors on November 5, 1990, via BOS Resolution No. 90-320. There have not been any requests for Extensions of Time. A letter had been sent to the owner notifying them that the approval of their rezoning has expired and an Extension of Time was required and that if an extension was not requested, it would be scheduled for rescission. In her letter dated September 4, 1998, Nancy Schaffer requested that the rezoning be rescinded. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1998, the Commission recommended that BOS Resolution No. 90-320 be RESCINDED mad that the zoning will revert to A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size). RESOLUTION NO. 98-438 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 18, I998, and posted on November 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1998, RESCINDED BOS Resolution No. 90-320 and REVERTED the zoning to A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size), as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
