HomeMy WebLinkAbout98-439 OFFICIAL RECORDS OF ~OI4~VE COONTY~ AZ 12/08/t9E8 03:33F' PAGE i [,~: 2 MOHAVE COUNTY BOARD OF.,UFER, RECORDING FEE 0.00 RESOLUTION NO. 98-439 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 91-296 WHICH APPROVED THE REZONE OF THE SOUTH 528 FEET OF THE EAST 330 FEET OF PARCEL 271, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolution for the Rezone for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owners are Jack C. and Gisela I. B. Dahl of Summerland, British Columbia, Canada, and WHEREAS, this property is located south of State Highway 68, between Egar Road and Estrella Road. The site is accessed from State Highway 68 via south on Egar Road to Mahone Drive, then east on Mahone Drive to the site, located on the northwest corner of Mahone Drive and Ehrenberg Road. The property is vacant and relatively flat, sloping slightly to the southeast. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to A-R/3A (Agricultural- Residential/Three Acre Minimum Lot Size) by the Mohave County Board of Supervisors on November 4, 1991, via BOS Resolution No. 91-296. There have not been any requests for Extensions of Time from the applicant. In his meeting with Karl Taylor, Planner II, on April 24, 1997, the property owner requested that the rezoning be rescinded. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. Ali notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1998, the Commission recommended that BOS Resolution No. 91-296 be RESCiNDED and that the zoning will revert to A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size). RESOLUTION NO. 98-439 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 18, 1998, and posted on November 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1998, RESCINDED BOS Resolution No. 91-296 and REVERTED the zoning to A-R/10A (Agricultural-Residential/Ten Acm Minimum Lot Size), as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
