A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE N1/3 OF LOT 30, ORO
ACRES, A SUBDIVISION OF SUNWARD HO! RANCHES, IN SECTION 6, TOV~NSHIP 22
NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/4A
(AGRICULTURAL-RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WItEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
7, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Nick A. Phillips of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road, between Calle Alamo and Calle
Castano. The site is accessed from Stockton Hill Road via east on Cactus Wren Road to Cherum Road, then
north on Cherum Road to Calle Castano, then east on Calle Castano to Avenida Ramirez, then north on
Avenida Ramirez to the property, located on the east side approximately 650 feet south of Calle Alamo. The
property has a single-family residence and a storage building on it. The property is relatively flat, sloping
slightly to the southeast. The surrotmding land uses consist of single-family residences and vacant land.
There are no significant drainage patterns, and
WItEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-
R/4A (Agricultural-Residential/FourAcre Minimum Lot Size) non-conforming zone. The Mohave County
General Plan designates this area as a Suburban Development Area. The Long Mountain Area Plan
designates this area as existing subdivided properties (High Density) not to be divided further without an
approved amendment to the area plan, per BOS Resolution No. 92-198, and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the sun-ounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 12, 1998, the Conmfission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a secondary residence on this property and the activities
related thereto. The floor area of the secondary residence shall comply with the size
requirements in Section 27.R (Accessory or Secondary Residence Requirements). Per the
Zoning Ordinance, the secondary residence will be used for nonpaying guests and relatives
only.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site
plan in accordance with Section 27.R must be completed and approved prior to approval of
permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Pemfit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 18, 1998, and posted on November 20, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 7, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
