RESOLUTION NO. 98-448
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 16-FOOT PUBLIC UTILITY
EASEMENT BETWEEN LOTS 3 AND 4, AND LOTS 12 AND 13, DIAMOND BAR ESTATES, IN
SECTION 25, TOWNSHIP 30 NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
7, 1998, a public hearing was conducted to determine whether approval should be granted to abandon the
above-described public utility easement as requested by Ted Levandowski, Meadview, Arizona, and
WHEREAS, the site is approximately four miles south of Meadview and two miles east of Pierce
Ferry Road. Access to the site is from Pierce Ferry Road via east by northeast on Sandview Drive to
Parkview Drive, then east on Parkview Drive to Sandy Point Drive. From Sandy Point Drive proceed north
to Bighorn Drive, then east on Bighorn Drive to its 90-degree intersection with Quail Run Lane and Quail
Run Cove. The easements are located east of Quail Run Lane and Quail Run Cove, and
WHEREAS, the site is vacant, as are the surrounding properties, with government lands to the east
and north. The site has moderate to steep slopes with a ravine traversing north to south along the eastern
third of the four lots. The abandonment will increase the buildable area of the site, and
WHEREAS, the Mohave County Department of Public Works and Citizens Utilities Rural Electric
Company do not object to the abando~wnent, and
WHEREAS, a review of FEMA FIRM Panel #040058-1300 indicates the parcel described to be in
Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action inteoded.
d. The site has legal access.
e. A ravine traverses the site in a north to south direction.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 12, 1998, the Commission recommended APPROVAL for the Abandonment subject to the
following:

1. The 16-foot public utility easement between Lots 3 and 4, and Lots 12 and 13, DIAMOND
BAR ESTATES, shall be abandoned.
2. Written concurrence, obtained by the owner, will be submitted to the County from all
affected utility companies.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 18, 1998, and November 25, 1998, and posted
November 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 7, 1998, APPROVED this Abandm~ment as recommended by the Mohave County
Planning and Zoning Conmfission and outlined herein.
