RESOLUTION NO. 98-203
A RESOLUTION SETTING FORTH A RESCISSION OF P&ZC RESOLUTION NOS. 86-10 AND
86-11, AND BOS RESOLUTION NO. 92-314, WHICH CONDITIONALLY APPROVED THE
PRELIMINARY PLAN, REZONING, AND REVISED PRELIMINARY PLAN FOR THE
UNRECORDED PORTION OF COURTNEY GREENS, TRACT 4054, BEING A SUBDIVISION
OF A PORTION OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH
MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave Comity Board of Supervisors held on June 1,
1998, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. The owner/developer of this property is John K. Hoover, Counsel Corporation, Santa
Ana Heights, California. The engineer of record is Burton Engineering, Inc., Las Vegas, Nevada, and
WHEREAS, the property is located approximately two miles south of Bullhead City. The site is
accessed via State Highway 95, then east one-half mile along Aztec Road, and
WHEREAS, the latest approved Revised Preliminary Plan depicts 9 acres subdivided into 36 single-
family residential lots, ranging in size from 8,000 to 13,000 square feet, and
WHEREAS, the original Preliminary Plan for Courtney Greens, Tract 4054, containing
approximately 80 acres, was approved by the Mohave County Board of Supervisors on March 17, 1986, per
P&ZC Resolution No. 86-10. The property was conditionally rezoned on the same date per P&ZC
Resolution No. 86-11. The Final Plat for Tract 4054-A was recorded December 31, 1986. An Extension
of Time of the approval for the unrecorded portion of the Preliminary Plan of Tract 4054 was approved on
August 6, 1990, per BOS Resolution No. 90-195. The Final Plat for Tract 4054-B was recorded October
1, 1990. A second Extension of Time was approved January 6, 1992, per BOS Resolution No. 92-10. The
third Extension of Time for the original Preliminary Plan of Tract 4054 was approved on April 6, 1992, per
BOS Resolution No. 92-105, and
WHEREAS, a Revised Preliminary Plan was submitted for the unrecorded portion of Tract 4054
lying north of the E1 Rodeo Drainage Channel (proposed as Courtney Greens, Tract 4054-C). This Revised
Preliminary Plan was approved by the Board of Supervisors on October 5, 1992, per BOS Resolution No.
92-314. The conditional rezoning of this property, per P&ZC Resolution No. 86-11, was to apply to the ne,v
subdivision proposal. The first Extension of Time for the Revised Preliminary Plan was approved by the
Board on December 5, 1994, per BOS Resolution No. 94-417. The second extension was approved on
November 6, 1995, per BOS Resolution No. 95-448. The third Extension of Time for the revised
Preliminary Plan of Tract 4054 was approved on November 4, 1996, per BOS Resolution No. 96-372, with
the Extension of Time expiring on October 5, 1997. No further extension was requested, and

WHEREAS, on May 14, 1997, the project engineer submitted a yet-revised Preliminary Plan for
the unrecorded portion of Tract 4054 lying north of the E1 Rodeo Drainage Channel (planned as Phase C).
This submittal changed the proposal from that approved in 1992, increasing the number of single-family
residential lots from 36 to 44, and switching from the R-1 zoning approved with the original and first-revised
plats to R-O, prohibiting mobile homes, and
WHEREAS, the Planning and Zoning Department, due to the continued evolution of this project
since its inception twelve years previous, and considering the Sketch Plan requirements to have been met
for this proposal, issued new Tract No. 4161 for use with this subdivision. The Preliminary Plan for Tract
4161 is now being processed to replace the unrecorded portion of old Tract 4054. A corrected submittal of
the Preliminary Plan for Tract 4161 must be made by the project engineer to the Planning Director,
addressing all regulation requirements and outstanding issues of review, prior to its being scheduled for
consideration by the Planning and Zoning Commission, and
WHEREAS, John K. Hoover, the owner and developer, has expressed his consent to the rescission
of all former approvals for the unrecorded portion of Courtney Greens, Tract 4054, to make way for his new
proposal, Courtney Greens, Tract 4161. The developer benefits from this action, in that if and when a
Preliminary Plan for Tract 4161 is approved, the approval of that new tract will be for the two-year period
provided in the Subdivision Regulations, with no further extensions of time required annually until the
expiration of that two-year approval, and
WHEREAS, all resolutions, including BOS Resolution Nos. 94-417, 95-448, and 96-372, which
require compliance with the conditions of the above-referenced rescinded approvals, are themselves voided,
and
WHEREAS, all notices have been advertised and posted according to regulations, and
WHEREAS, at the public heating before the Mohave County Planning and Zoning Connnission on
May 13, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave Count5', Arizona, May 16, 1998, and posted on May 15, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Boaxd of Supervisors, at their regular meeting
