HomeMy WebLinkAbout98-207~,, ~,~,~ : ~-~ INDEXED i~ICROFI~EI ' "'~"'"1"~::~ OFFICIAL RECORDO OF ~OH~VE COUNTY~ AZ ,,~ 06103/98 O~:30P F'~GE ~ OF 2 ~-~ HOHAVE COUNTY BOARD OF SUF'ERVISgRS RECOROING FEE RESOLUTION NO. 98-207 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE S½ OF LOT 7, BLOCK N, GOLDEN SAGE RANCHOS, UNIT 55, IN SECTION 11, TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Kerry A. and Toni A. Engmark of Golden Valley, Arizona, and WltEREAS, this property is located south of State Highway 68, between Bacobi Road and Aztec Road. The site is accessed from State Highway 68 via south on Houck Road to the site, located approximately 300 feet north of Shipp Drive. The property has a single-family residence on it and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone for Mr. Engmark's mother. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEIVlA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: BAGE 2 OF 2 BE ~098 PG 751 F~ · '% RESOLUTION NO. 98-207 Page 2 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is sub.~ect to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
