HomeMy WebLinkAbout98-208 ~' .:~,., INDEXED ~;.5;.~%~y~ JOAN MC C~LL, MOH~VE COUNTY RECORDER 4 t:;~ 06/03/98 Ot:~OP PAGE i Or 2 ~,~ MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE O,00 RESOLUTION NO. 98-208 EVALUATION OF A REQUEST FOR AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF PARADISE TRAILS, TRACT 3802, BEING A SUBDIVISION OF THE PORTION OF SECTION 25, TOWNSHIP 18 NORTH, RANGE 18 WEST, LYING WEST OF THE INTERSTATE 40 RIGHT-OF-WAY, IN THE YUCCA PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1998, a public heating was conducted to determine whether approval should be granted for an Extension of Time as requested by the developer, Rubal Ruther of Double R Development, Lake Havasu City, Arizona, for the above-described Preliminary Plan. The project engineer of record is Todd Bremner, Lake Havasu City, Arizona, and WHEREAS, the property is located approximately 17 miles south of the City of Kingman and two miles north of the Yucca townsite. The site is accessed via the Old Trails interchange of Interstate 40 and lies immediately west of the highway right-of-way, and WHEREAS, the Preliminary Plan depicts 149 acres subdivided into 94 residential lots and 16 commercial lots. The residential lots range in size from one-half acre to one and one-half acres. The commercial lots range in size from one acre to slightly mom than seven acres. The subdivision also includes a drainage parcel and a parcel for a well site, and WHEREAS, the developer has indicated in a letter dated March 23, 1998, that an Extension of Time is being requested in order to give the developer more time to have his project engineer submit a Final Plat for the entirety of/he project. In his letter the developer indicates that ADEQ has issued an approval to construct (the letter does not specify water or sewer improvements) and that the approval expires on"l 2-31- 98 with no allowance for extension." The ADEQ approvals for this subdivision were not included with this request. The developer, in attempting to have the subdivision completed by that date, intends to resume plat processing soon with the submittal of the Final Plat, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on May 1, 1995, per BOS Resolution No. 95-193. The first Extension of Time of the approved Preliminary Plan was granted on June 2, 1997, per BOS Resolution No. 97-188. Subdivision Regulations, Article 3.10-1, states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and F'A61E_ 2 OF 2 BK 3098 P6 753 FEE~9,SO~57 RESOLUTION NO. 98-208 Page 2 WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, this action, if approved, will be the second Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request complies with the Extension of Time Policy due to the following: The first extension request was granted in part based on the developer's claim of economic hardship, due to the closing of the paper plant near Yucca. The policy normally limits the use of "economic hardship" as a reason for extension approval to one extension. The developer made no claims of economic hardship with this request. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conunission on May 13, 1998, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 95-193 and 97-188. 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until May 1, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, Ma3, 16, 1998, and posted on May 15, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
