RESOLUTION NO. 98-209
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF PARCEL
26-1, MOUNTAIN VISTA RANCHES, PHASE I, IN SECTIONS 26 AND 27, TOWNSHIP 24
NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX
ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A AND A-R/14A (AGRICULTURAL-
RESIDENTIAL/FIVE ACRE AND FOURTEEN ACRE MINIMUM LOT SIZE) ZONES, IN THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June I,
1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above-described property as requested by Harold and Yvonne Tolley of Kingman, Arizona,
and
WHEREAS, this property is located northwest of State Highway 66 and west of Antares Road. The
site is accessed from State Highway 66 via north on Concho Drive to Painted Rock Drive, then east and
northeast on Painted Rock Drive to the site, located on the southwest corner of Painted Rock Drive and
Huntington Avenue. The property is vacant. There are no significant drainage patterns. The Mohave
County General Plan designates this area as a Rural Development Area, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on August 5, 1996, via BOS Resolution No. 96-294. This Extension of Time will allow the applicant to
complete the Parcel Plat as required by BOS Resolution No. 96-294, and
WHEREAS, the property owner has not submitted the required Parcel Plat and has not
accomplished any of the other conditions of approval as required by BOS Resolution No. 96-294, and
WHEREAS, this will be the first and second Extensions of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-2025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
fi There are no significant environmental features affecting the site.
g. This request complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Cormnission on
May 13, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Compliance with the conditions of BOS Resolution No. 96-294.
2. This Extension of Time will be in effect until August 5, 1998.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution No. 96-294.
WHEREAS, the notice of hearing was published in The Standard, a ne~vspaper of general
circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June I, 1998, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
