HomeMy WebLinkAbout98-215 INDEXED OFFICIAL_ RECORDS OF MOHAVE £:DUNTY~ AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 06/03t98 ~1:32P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RESOLUTION NO. 98-215 A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON THE SOUTH 635 FEET OF THE EAST 342.9 FEET OF THE SW¼ SW¼ SW¼ OF SECTION 20, IN TOWNSHIP 23 NORTH, RANGE 13 WEST, FOR A WATER BOTTLING PLANT IN AN M (GENERAL MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1998, a public hearing was conducted to determine whether a Specific Use Permit should be granted for the above-described property as requested by the Claude K. Neal Family Trust, being represented by B. Marc Neal, Co-Trustee, of Kingman, Arizona, and WHEREAS, this property is located south of State Highway 66 (Old US Highway 66) and west of Hackberry Road. The site is accessed from State Highway 66 via south on Hackberry Road approximately one-half (0.5) mile to a roadway easement known as Neal Easement, then west on Neal Easement to the site, located approximately one-quarter mile west of Hackberry Road. The property has a 50 foot x 120 foot steel building under construction, with a permit, on it. The terrain is gently rolling hills, generally sloping to the northeast. The surrounding land uses consist of vacant land, open range land and a few scattered single- family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Specific Use Permit to allow for a water bottling plant. The applicant has rezoned a five-acre portion of the 45.1-acre parcel to M (General Manufacturing). The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2200B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. PAGE 2 OF 2 R,K 3098 F'G 770 FEE~98032263 RESOLUTION NO. 98-215 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1998, the Commission recommended APPROVAL for a Specific Use Permit subject to the following: 1. This Specific Use Pemfit is intended for a water bottling plant and activities related thereto; any new use will require another Specific Use Permit. 2. The Specific Use Permit will commence upon the effective date of the rezone. 3. The applicant shall comply with all applicable requirements of the Arizona Department of Environmental Quality (ADEQ) and Arizona Department of Water Resources (ADWR). 4. Approval of a Specific Use Permit with such conditions and restrictions as the Board of Supervisors may impose, shall be valid for two (2) years, in which time construction on the project shall commence or the use authorized shall be initiated. Prior to expiration of the approval, the developer may request an Extension of Time from the Commission to initiate the project, and the Commission shall recommend to the Board an action based upon a finding of substantial grounds of which to grant such an Extension of Time up to one (1) year. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1998, APPROVED this Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
