RESOLUTION NO. 98-216
A RESOLUTION SETTING FORTH A REZONE OF THE SOUTHERLY 430 FEET OF THE
EASTERLY 300 FEET OF PARCEL 240, STOCKTON HILL RANCHES, UNIT 8, IN THE NW¼
SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM A-R/10A (AGRICULTURAL-
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO C-RE (COMMERCIAL-
RECREATION) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1,
1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Gezina and Fehkje Schippers of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road and between Jane Avenue and
Jeffrey Avenue. The site is accessed from Stockton Hill Road via east on Jane Avenue to Parker Street, then
north on Parker Street to Evelyn Avenue, then west on Evelyn Avenue to the site, located on the northeast
comer of Mountain View Drive and Evelyn Avenue. The property has a single-fmnily residence and several
accessory buildings on it. The terrain is rolling hills rising to the northwest and generally sloping to the
southeast. The surrounding land uses consist of vacant lots and a few scattered single-family residences.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for a small bed and breakfast facility
along with astronomy activities and tours of northern Arizona, for seven people or less, using a four-wheel
drive vehicle. The applicant proposes to rezone the southerly 430 feet of the easterly 300 feet of the 40-acre
Parcel 240, approximately three acres. The Mohave County General Plan designates this area as a Suburban
Development Area and the Long Mountain Area Plan designates this area RR/5A (Rural Residential/Five
Acre Minimum Lot Size), and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies w/th the Mohave County General Plan and the
Long Mountain Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 13, 1998, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The southerly 430 feet of the easterly 300 feet of Parcel 240 will be rezoned C-RE
(Commercial-Recreation) as shown on Exhibit "A." The bed and breakfast operation may
not be expanded from the requested size.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. That 42 feet of the existing 50-foot roadway and utility easement, known as Jeffrey Drive
and Linger Street, and 30 feet of the existing 50-foot roadway and utility easement, known
as Mountain View Drive mad Evelyn Avenue Street, shall be dedicated to the public and
accepted by the Mohave County Board of Supervisors as road right-of-way. In addition,
20-foot radius curves are required at all dedicated roadway intersection points.
4. The remaining eight feet of the existing 50-foot roadway and utility easement, known as
Jeffrey Drive and Linger Street, and the remaining 20 feet of the existing 50-foot roadway
and utility easement, known as Mountain View Drive and Evelyn Avenue Street, shall be
granted to the public as a Public Utility Easement (PUE) and drainage easement.
5. All rights-of-way dedicated and public easements granted may be accomplished by separate
instrument and will be accepted by the Board of Supervisors.
6. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
7. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
8. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June 1, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
