WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1998, a public hearing was conducted to detem~ine whether a Zoning Use Permit should be granted for the above-described property as requested by Claudia M. and Timothy J. Ryan of Kingman, Arizona, and WHEREAS, this property is located northeast of Hualapai Mountain Road and northwest of D.W. Ranch Road. The site is accessed fi'om Kingman via southeast on Hualapai Mountain Road approximately 7.7 miles to D.W. Ranch Road, then northeast on D.W. Ranch Road to Metate Drive, then northwest on Metate Drive to Wagon Wheel Road, then northeast on Wagon Wheel Road to the site, located on the southeast side at the T-intersection of Wagon Wheel Road and Thunderhead Drive. The property has a single-family residence on it and the terrain is rolling hills. The surrounding land uses consist of single- family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a travel trailer to be used as a secondary residence for the applicant's mother. The Mohave County General Plan designates this area as a Rural Development Area and the Pinion Pines area is considered an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. F'~GE 2 OF 2 B~ 309~ PG 776 FEE~9803226~ RESOLUTION NO. 98-217 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a travel trailer to be used as a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R, Amended (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R, Amended, must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. 6. This Zoning Use Permit is approved for one year and expires June 1, 1999. Travel trailers allowed as secondary residences shall be approved by the Board of Supervisors in one-year increments following a recommendation from the Planning and Zoning Commission. An application for an Extension of Time must be applied for. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 16, 1998, and posted on May 15, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County and outlined herein. ~,~- .~ MOH~UPERVISORS :: James
