RESOLUTION NO. 98-221
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 16-FOOT PUBLIC UTILITY
AND DRAINAGE EASEMENT BETWEEN LOTS 67 AND 68, MEADVIEW FOOTHILLS, TRACT
1198, IN SECTION 12, TOWNSHIP 30 NORTH, RANGE 17 WEST, IN THE MEADVIEW
PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1,
1998, a public hearing was conducted to determine whether approval should be granted to abandon the
above-described public utility and drainage easement as requested by Ted Levandowski of Meadview,
Arizona, and
WHEREAS, this property is located east of Pieme Ferry Road, between Pueblo Drive and Bradley
Bay. The site is accessed from Pierce Ferry Road via east on Meadview Boulevard to Shore Avenue. The
site is approximately one-eighth (1/8) mile south of Meadview Boulevard on the west side of Shore Avenue.
The terrain slopes eastward to Shore Avenue, falling some 20 vertical feet in I30 feet measured along the
common lot line shared by Lots 67 and 68. The surrounding land uses consist of vacant parcels and several
single-family residences. There is a wash along the south side of Lot 68.
WHEREAS, the Mohave County Department of Public Works does not object to the abandoranent
of the drainage easement. The Department found that natural drainage does cross the site; however, the
location of the natural drainage is such that the drainage easement cannot be used to route the flows.
WHEREAS, Citizens Utilities Rural Company, Inc. electrical and telephone divisions do not object
to the abandomnent of the public utility easement; however, the water and gas divisions question the wisdom
of the abandonment because water and gas lines should not be dead-ended. The Mohave County
Department of Public Works does not object to the abandonment of the public utility easement and feels
confident that future water and gas lines will be placed along the front of the lots rather than in the rear
public utility easement, and
WHEREAS, a review of FEMA FIRM Panel #040058-1300B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect of abandoning the drainage easement does not appear to
conflict with Goals 49 and 50 the Mohave County General Plan, which encourage minimal
impact on downstream properties via the undisturbed flow of natural drainage ways.

c. The site is adequate for the action intended.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning mad Zoning Commission on
May 13, 1998, the Comurission recommended APPROVAL for the Abandonment of the drainage easement
and NO OBJECTION to the Abandonment of the public utility easement.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, May 16, 1998, and May 23, 1998, and posted May 15,
1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Boaxd of Supervisors, at their regular meeting
on Monday, June 1, 1998, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
