RESOLUTION NO. 98-236
A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-1 AND 91-
2, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING FOR
THE UNRECORDED PORTION OF LAKERIDGE ESTATES, TRACT 3035, BEING A
SUBDIVISION OF A PORTION OF THE NORTH HALF OF SECTION 21, TOWNSHIP 14
NORTH, RANGE 20 WEST, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
8, 1998, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. The owner/developer is Steven Palazzola, Scottsdale, Arizona. The project engineer
for Tract 3035 was Hess-Rountree Inc., Phoenix, Arizona, and
WHEREAS, the property is located approximately one-half mile north and west of Lake Havasu
City. The property is accessed via State Highway 95, then west along and south of Chenoweth Drive to the
site, and
WHEREAS, the Preliminary Plan depicts 80 acres subdivided into 231 single-family residential lots,
and
WHEREAS, the Preliminary Plan for Lakeridge Estates, Tract 3035, was approved by the Mohave
County Board of Supervisors on January 7,1991, per BOS Resolution No. 91-1. The rezoning of the
property was conditionally approved on the same date per BOS Resolution No. 91-2. The Final Plat for
Phase A was approved on January 7,1992, per BOS Resolution No. 92-22. The first Extension of Time for
the Preliminary Plan was granted by the Board on March 8, 1993, per BOS Resolution No. 93-53. The
second extension was granted on April 4, 1994, per BOS Resolution No. 94-101. The third Extension of
Time was granted on March 10, 1995, per BOS Resolution No. 95-80. The fourth extension was granted
on May 6, 1996, per BOS Resolution No. 96-141. The fifth extension was granted on April 7,1997, per
BOS Resolution No. 97-96, expiring automatically on January 7, 1998, and
WHEREAS, the Final Plat for Phase A of this subdivision was recorded on June 26, 1992. No Final
Plat was ever submitted for proposed Phase B, and
WHEREAS, the developer submitted a request earlier this year for another Extension of Time of
the old Preliminary Plan approval for Tract 3035. At their meeting on March 11, 1998, the Planning and
Zoning Commission continued the hearing of the Extension of Time for 90 days, due to the lack of plat

processing, concerns of the property owners association, and the continuing negotiation between the
developer and the County regarding the method of assurances proposed for Phase B. During the period of
continuance staff confirmed with the developer, and with the new project engineer, William T. Miller, that
the developer intends to submit a new subdivision design, and has abandoned the use of the old, approved
subdivision layout for what had originally been planned as Tract 3035-B. As the old project has been
abandoned by the developer in favor of a new subdivision design, no further Extensions of Time are
necessary for the old approvals, and
WHEREAS, the owner/developer has expressed his consent to the rescission of all former approvals
for the unrecorded portion of Lakeridge Estates, Tract 3035, to make way for his new proposal. The project
engineer is preparing a Sketch Plan of the new subdivision, and
WHEREAS, all resolutions, including BOS Resolution Nos. 93-53, 94-101, 95- 80, 96-141, and 97-
96, which require compliance with the conditions of the above-referenced rescinded approvals, are
themselves voided, and
WHEREAS, all notices have been advertised and posted according to regulations, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Cormnission on
June 10, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of heating was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED the rescission of this subdivision as recommended by the
Mohave County Pltuming and Zoning Commission and outlined herein.
