HomeMy WebLinkAbout98-237 RESOLUTION NO. 98-237 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR THE COMPLETION OF IMPROVEMENTS IN MESA VILLAS, TRACT 4146, BEING A SUBDIVISION OF A PORTION OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to determine whether an Extension of Time should be granted for the assurances for the completion of all improvements in the above-referenced subdivision. The developer of the subdivision is Debra Grissom, Northridge, California. The project engineer of record is Burton Engineering, Inc., Las Vegas, Nevada, and WHEREAS, the Final Plat of Mesa Villas, Tract 4146, was recorded on June 19, 1995. The subdivision was not phased. Article 5.4 of the Mohave County Subdivision Regulations states: "The duration of the performance bond or other assurance shall be for one (1) year from the date of recording. Extensions of Time in one (1) year increments may be granted by the Board of Supervisors by showing just cause.", and WHEREAS, the assurances posted for this project expired on June 19, 1996. The first and second Extension of Time for this assurance was approved by the Board of Supervisors on February 2, 1998, per BOS Resolution No. 98-49. That extension expires June 19, 1998, and WHEREAS, the developer has submitted As-Built Improvement Plans for some improvements already completed in the subdivision. The County has approved these plans and partial releases of the assurances posted for the improvements in this project, equal to the amount of the improvements completed. The outstanding assurance balance as of the latest partial release dated June 11, 1996, is $16,216.09. The developer appears to be making progress toward the completion of the improvements required for the subdivision, and WHEREAS, the Public Works Department has commented that the project engineer must submit a progress report, including the amount of improvements completed, the amount of improvements remaining, and an expected date of completion of the improvements, and WHEREAS, this action, if approved, will be the third Extension of Time for this assurance, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission recommended APPROVAL of the Extension of Time for the Assurances for the completion of subdivision improvements for Mesa Villas, Tract 4146, subject to the following: RESOLUTION NO. 98-237 Page 2 1. The developer must, within 90 days of the date of Board approval of this extension, submit to the Public Works Department a progress report prepared by the project engineer, including a description of the amount of improvements completed in the subdivision, the amount of improvements remaining, and an expected date of completion of the improvements. 2. This Extension of Time will be in effect until June 19, 1999. WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 13, 1998, APPROVED this Extension of Time for the Assurances for the completion of subdivision improvements for Mesa Villas, Tract 4146, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
