ON LOT 11, BLOCK 3, PERRY ACRES, TRACT 4007, IN SECTION 13, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE V/~LLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to detemfine whether a Zoning Use Permit should be granted for the above-described property as requested by Waldemar and Sofie M. Illmer and Heidi Koehly of Mohave Valley, Arizona, and WHEREAS, Sis property is located east of State Highway 95, between Jerome Avenue and Hulet Avenue. The site is accessed from State Highway 95 via east on Jerome Avenue to Mountain View Road, then south on Mountain View Road to the site, located on the east side between Paul Road and Ann Road. The property has a single-family residence and an accessory building on it and the terrain is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of single-fanfily residences and vacant lots. There are no significant drainage patterns, and WZtEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence for their daughter in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and VOtEREAS, a review of FEMA FIRM Panel #040058-2610C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission reconmaended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION ]NO. 98-238 Page 2 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, th~ notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 13, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
