HomeMy WebLinkAbout98-239 RESOLUTION NO. 98-239 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 95-477 AND 95-478, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING FOR SAGECREEK ESTATES, TRACT 4155, BEING A SUBDIVISION OF A PORTION OF SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The owners/developers are Joe Watson, authorized agent, and Karen Barney-Moore, both of Henderson, Nevada. The project engineer was Burton Engineering, Inc., Las Vegas, Nevada, and WHEREAS, the property is located immediately south of Bullhead City. The property is accessed via State Highway 95, then east one mile along Camp Mohave Road, then north one-half mile along Mountain View Road, and northwest to the site, and WHEREAS, the Preliminary Plan depicts 80 acres subdivided into 289 single-family residential lots, four drainage parcels and one roadway turnaround parcel, constituting 13 phases. Residential lots in the subdivision were to contain between 7,000 and 15,000 square feet in area, and WHEREAS, the Preliminary Plan for Sagecreek Estates, Tract 4155, was approved by the Mohave County Board of Supervisors on December 4, 1995, per BOS Resolution No. 95-477. The rezoning of the property was conditionally approved on the same date per BOS Resolution No. 95-478. The Preliminary Plan app,'oval for this tract expired automatically on December 4, 1997. The developer did not request an Extension of Time for the approval of the project. No Final Plat was ever submitted for this subdivision, and WHEREAS, prior to the approval of the Preliminary Plan for Sagecreek Estates, Tract 4155, this property had been conditionally approved as The Overlook, Tract 4137, per BOS Resolution No. 91-147. The developers and engineer for that project significantly redesigned the subdivision, requiring the developers to start over processing as a new Sketch Plan, that submitted for Sagecreek Estates, Tract 4155, and WHEREAS, Joe Watson, a developer and agent for this subdivision, informed County staff on December 5, 1997 that he did not intend at this time to process a subdivision for this property, and expressed consent to the rescission of the approvals for the project, and RESOLUTION NO. 98-239 Page 2 WHEREAS, all resolutions, including BOS Resolution Nos. 91-147, 91-205, 93-125, and 94-204, which require compliance with the conditions of the above-referenced rescinded approvals, and those resolutions relating to the preceding proposals are themselves voided, and WHEREAS, all notices have been advertised and posted according to regulations, and WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 13, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
