HomeMy WebLinkAbout98-245 INDEXED ~ICROFILME[~ ~'80~1,,~6:E~ BK 3122 PG 8-.~ OFFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAN KC CALL~ ~OH~VE COUNTY RECORDER 07/1~/98 02:18P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE RESOLUTION NO. 98-245 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE S½ NE¼ NE¼ OF LOT 2, SO-HI ESTATES, UNIT TWO, FIRST AMENDED, IN SECTION 31, TOWNSHIP 22 NORTH, RANGE 17 WEST, FOR AN OFFICE, STORAGE, AND MEETING FACILITY FOR THE SO-HI WATER DISTRICT, IN AN R-E (RESIDENTIAL-RECREATION) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by the So-Hi Domestic Water Improvement District of Kingman, Arizona, being represented by Keith Curry, chairman of the water district board, and WHEREAS, this property is located east of US Highway 93 and north of Agua Fria Drive. The site is accessed from US Highway 93 via east on Ranch Road to So-Hi Boulevard, then south on So-Hi Boulevard to the site, located on the west side approximately 170 feet south of Ranch Road. The property is vacant and the terrain is gently rolling hills, generally sloping to the southwest. The surrounding land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an office, storage, and meeting facility for the So-Hi Water District. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2150B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the sun-ounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: Pr%GE 2 OF 2 BK 3122 P6 81)6 FEE~g80¢l~68 RESOLUTION NO. 98-245 Page 2 1. This Zoning Use Pem~it is for an office, storage building, and meeting facility for the So-Hi Water District and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. The applicant shall provide right-of- way, road and drainage improvements as required by the Mohave County Engineer prior to site plan approval. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 13, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
