HomeMy WebLinkAbout98-249 INDEXED ~'80~:14-72 BK 3522 PG OFFICIAL RECORDS OF ~OHAVE COUNTY~ AZ JOAN MC CALL~ ~OHAVE COUNTY RECORDER 07/1~/~8 02:20P PAGE 1 OF ~)OHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE RESOLUTION NO. 98-249 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 72, LAZY Y-U RANCH, PHASE II, IN THE NE¼ SW¼ OF SECTION 4, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/ 36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A, A-R/9A AND A-R/12A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE, NINE ACRE, AND TWELVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Robert M. Jankowski and Mae Wright of South Wales, New York, and WHEREAS, this property is located southeast of the City of Kingman and south of Hualapai Mountain Road. The site is accessed from Hualapai Mountain Road via south-southwest, then northwest, then west-southwest on Lazy Y-U Drive to Stagecoach Drive, then west and north on Stagecoach Drive approximately one-half mile to the eastern boundary of the property, which is bisected east-west by Stagecoach Drive. The property is vacant, and the terrain is rolling hills. The surrounding land uses consist of vacant parcels. There are no significant drainage pa~terns, and WHEREAS, the applicant requests this zone change to allow for development. The applicant proposes to divide the 39.56-acre parcel into one approximately 7.5-gross-acre parcel, one approximately 6-gross-acre parcel, one approximately 11-gross-acre parcel, and one approximately 15-gross-acre parcel. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Haz~xd Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. ¢. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. f. There are,no significant environmental features affecting the site. P/~GE 2 OF ~ 3122 P6 815 FEE¢98041¢72 RESOLUTION NO. 98-249 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The northeastem and southwestern parcels will be rezoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size); the northwestern parcel will be rezoned A-R/12A (Agricultural-Residential/Twelve Acre Minimum Lot Size), and the southeastern parcel will be rezoned A-R/9A (Agricultural-Residential/Nine Acre Minimum Lot Size) as shown on Exhibit "A." 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The roadway easement line and/or centerline monuments for Stagecoach Drive will be set per minimum Mohave County standards. 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. 6. The applicable flood zone(s) shall be noted on the Parcel Plat. 7. The appropriate zoning, building, environmental, and floodpla'm permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 8. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 1 I, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted June 26, 1998, as required by Arizona Revised Statutes and tbe Mohave County Zoning Regulations. PAGE 3 OF 4 BK 3122 PG B16 FEE$?80¢1~72 RESOLUTION NO. 98-249 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 13, 1998, APPROVED this Rezone as recommended by the Mohave County Plmming and Zoning Commission and outlined herein.
