WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13, 1998, a public hearing was conducted to determine whether approval should be granted for the rescission of BOS Resolution No. 95-142 for the rezone of the above-described property as requested by John P. Allison, Project Manager, NcwCut, Inc., o£ Lake Havasu City, Arizona, and WHEREAS, this property is located southeast of Interstate 40 approximately five miles from the Interstate 40/Franconia exit. This property is accessed from Interstate 40 via the Franconia exit. The site is accessed from an old mining road, which is an undocumented roadway. The property is relatively flat with the terrain sloping to the southeast. The surrounding land is vacant, and WHEREAS, tiffs property was conditionally approved for a rezone to M-X by the Mohave County Board of Supervisors on May 1, 1995, via BOS Resolution No. 95-142 for the construction of a non- chemical use mill site for a mining project. In their letter dated April 14, 1998, the property manager requested that the rezoning be rescinded because NewCut, Inc., operates a mining project and under ARS I 1-830, mining projects are exempt from zoning. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the 'following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 10, 1998, the Commission recommended that BOS Resolution No. 95-142 be RESCINDED, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
