A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 19 AND 20, BLOCK 5,
NEW KINGMAN ADDITION, UNIT 3, IN SECTION 33, TOWNSHIP 22 NORTH, RANGE 16
WEST, FOR A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE KINGMAN
AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 13,
1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Robert W. Weatherford of Oceanside, California, and
WHEREAS, this property is located northwest of State Highway 66 (Old US Highway 66) and
northeast of Gordon Drive. The site is accessed from State Highway 66, via northwest on Martin Lane to
the site, located on the east comer of Mallard Drive and Martin Lane. The property is vacant and the terrain
is relatively flat, sloping slightly to the west. The surrounding land uses consist of single-family residences
to the northwest, several vacant lots and a variety of commercial businesses to the southeast between
Mallard Drive and State Highway 66. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2 (General
Commercial) zone. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 10, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a residence in a C-2 (General Commercial) zone and activities
related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Perufit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 27, 1998, and posted on June 26, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 13, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
