JOAN MC CALL, MOHAgE COUNTY RECORDER  ' ~ 08/12/98 D4:29P PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 RESOLUTION NO. 98-270 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE S'/2 SW¼ NW¼ OF SECTION 13, EXCEPT FOR THE INTERSTATE 40 AND STATE HIGHWAY 95 RIGHTS-OF- WAY, IN TOWNSHIP 16 NORTH, RANGE 20 WEST, FROM C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE TO M (GENERAL MANUFACTURING) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10, 1998, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above-described property as requested by the Pilot Corporation, being represented by Danny Gregory. The Pilot Corporation is located in Knoxville, Tennessee, and WHEREAS, this property is located on the southeast comer of the intersection of Interstate 40 and State Highway 95 mad is accessed directly from State Highway 95 to the east. The property is vacant and the terrain is relatively flat, sloping slightly to the west. The surrounding land uses consist of vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for the construction of a 17,000 Gallons Per Day (GPD) wastewater treatment facility to serve the Pilot Service Station on this location. This property was rezoned to C-2H (General Commercial Highway Frontage) on August 4, 1997, via BOS Resolution No. 97-283. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2805C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plata. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on Jnly 8, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: PAGE 2 OF' ~ BK L~141 F'G .~76 FEE$98048495 RESOLUTION NO. 98-270 Page 2 1. The southeastern 270.16 feet by 322.48 feet of this property will be rezoned M (General Manufacturing) to allow for a 17,000 Gallons Per Day (GPD) wastewater treatment facility to serve the Pilot Service Station on this location, as shown on Exhibit "A". 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 5. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mall to the owner and applicant who requested the rezoning) shall schedule a public hearing to grm~t an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Aunotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ._O.AW ;UPERVISORS
