ECORDER 08/12/~8 04:~2P PAGE 1 OF 2 MOHAVE COUNTY 80ARQ OF SUPERVISORS RECQRDING FEE 0.00 RESOLUTION NO. 98-277 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-93 AND 91-121, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING FOR TOPOCK SPRINGS ESTATES, TRACT 4125, BEING A SUBDIVISION OF A PORTION OF THE NW~A OF SECTION 23, TOWNSHIP 16 NORTH, RANGE 21 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WltEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August i0, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The owner/developer is Bill Jordan, Kingman, Arizona. The project engineer is Kirkham Michael Consulting Engineers, Phoenix, Arizona, and WHEREAS, the property is located south of the Golden Shores area on the west side of Oatman Highway, and WHEREAS, the Preliminary Plan depicts 82 acres subdivided into six parcels which will include a travel trailer park, multiple-family traits, some commercial uses, and several linear parks as greenbelt areas for open spaces and recreation, and WHEREAS, the Preliminary Plan for Topock Springs Estates, Tract 4125, was approved by the Mohave County Board of Supervisors on April 2, 1991, per BOS Resolution No. 91-93. The rezoning of the property was conditionally approved on May 1, 1991, per BOS Resolution No. 91-121. The first Extension of Time of the approval of the Preliminary Plan was granted May 3, 1993, per BO S Resolution No. 93-118. The second extension was granted on September 6, 1994, per BOS Resolution No. 94-203. The third extension was granted on June 5, 1995, per BOS Resolution No. 95-221. The fourth extension was granted on June 3, 1996, per BOS Resolution No. 96-183. The Preliminary Plan approval for this tract expired automatically on April 2, 1997. The developer did not request a further Extension of Time for the approval of the project. No Final Plat was ever submitted for this subdivision, and WHEREAS, the developer informed County staff on June 11, 1998, that he does not intend to process a subdivision for this property at this time, and expressed consent to the rescission of the approvals for the project, and WHEREAS, all resolutions, including BOS Resolution Nos. 93-118, 94-203, 95-221, and 96-183 which required compliance with the conditions of the above-referenced rescinded approvals, axe themselves voided. All notices have been advertised and posted according to regulations, and F'~6E 2 BK S~ F'G ~'~ ~-~ F'EE~gR34851"2 RESOLUTION NO. 98-277 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingmmr, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
