HomeMy WebLinkAbout98-280 JO~N HC (:~LL~ ~OH~VE (:OUNTY RECORDER 08/12/98 04:33F' PAGE I OF 2 flOHAVE COUNTY BOARD OF SUPERVISORS RE[:ORDIN6 FEE 0.00 RESOLUTION NO. 98-280 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 94-174, 94-175, 94-176, AND 95-26, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN, REZONING, AN ABANDONMENT OF ROADWAYS, AND THE FINAL PLAT FOR BLACK HILLS RANCHOS, TRACT 3301, BEING A SUBDIVISION OF A PORTION OF PARCEL 284, IN THE NW¼ OF THE NW¼ OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The o~vner/developer is Judith Chen of the City of Industry, California. The project engineer is Mohave Engineering Associates, Inc., Kingman, Arizona, and WHEREAS, the property is located approximately l 1 miles west of the City of Kingman. The property is accessed via State Highway 68, then south on Estrella Road, then east along and north of Crystal Drive, and WHEREAS, the Preliminary Plan depicts 10 acres subdivided into 23 single-family residential lots, and WHEREAS, the Preliminary Plan for Black Hills Ranchos, Tract 3301, was approved by the Mohave County Board of Supervisors on June 6, 1994, per BOS Resolution No. 94-174. The rezoning of the property was conditionally approved on the same date per BOS Resolution No. 94-175. The Final Plat for this subdivision was approved by the Board of Supervisors on January 17, 1995, per BO S Resolution No. 95-26. The first and only Extension of Time for the approval of the Preliminary Plan was granted on August 5, 1996, per BOS Resolution No. 96-280. The Preliminary Plan approval for this tract expired automatically on June 6, 1997. The developer did not request a further Extension of Time for the approval of the project, and WHEREAS, the developer informed County staff on June 11, 1998, that she did not intend to process a subdivision for this property at this time, and expressed consent to the rescission of the approvals for the project, and WHEREAS, all resolutions, including BOS Resolution No. 96-280 which required compliance with the conditions of the above-referenced rescinded approvals, are themselves voided. All notices have been advertised and posted according to regulations, and PC~GE 2 OF 2 BK 31~1 P6 4-22 FEE:~-9804-$50!5 RESOLUTION NO. 98-280 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, I998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
