RESOLUTION NO. 98-281
A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 94-390 AND
94-391, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING
FOR ROYAL ESTATES, TRACT 3302, BEING A SUBDIVISION OF PARCEL 280, A PORTION
OF THE SW¼ OF THE SW¼ OF SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN
THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10,
1998, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. The owner/developer is Judith Chen of the City of Industry, California. The project
engineer is Mohave Engineering Associates, Inc., Kingman, Arizona, and
WHEREAS, the property is located approximately 10 miles west of the City of Kingman. The
property is accessed via State Highway 68, then south on Egar Road to the site, northeast of the intersection
of Egar Road and Shipp Drive, and
WHEREAS, the Preliminary Plan depicts 40 acres subdivided into 123 single-family residential lots,
three drainage parcels, a 1.6-acre parcel reserved for a wastewater treatment plant, and an approximately
1 $,000-square-foot neighborhood park, and
WHEREAS, the Preliminary Plan for Royal Estates, Tract 3302, was approved by the MohaYe
County Board of Supervisors on November 3, 1994, per BOS Resolution No. 94-391. The rezoning of the
property was conditionally approved on the same date per BOS Resolution No. 94-390. The first and only
Extension of Time for the approval of the Preliminary Plan was granted on December 2, 1996, per BOS
Resolution No. 96-413. The Preliminary Plan approval for this tract expired automatically on November
3, 1997. The developer did not request a further Extension of Time for the approval of the project. No Final
Plat was ever submitted for this subdivision, and
WHEREAS, the developer informed County staff on June 11, 1998, that she did not intend to
process a subdivision for this property at this time, and expressed consent to the rescission of the approvals
for the project, and
WHEREAS, all resolutions, including BOS Resolution No. 96-413 which required compliance with
the conditions of the above-referenced rescinded approvals, are themselves voided. All notices have been
advertised and posted according to regulations, and

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
July 8, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, August 10, 1998, APPROVED the rescission of this subdivision as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
