OARO OF SUF'ERVISORS RECORDING FEE ri.D0 RESOLUTION NO. 98-282 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-51, 91-76, 91-77, 91-212, 91-224 AND 93-318 WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN, REZONING, A SEPARATE PETITION OF EXCEPTION, ABANDONMENT OF ROADWAY EASEMENT, AN AMENDMENT TO THE PRELIMINARY PLAN APPROVAL, AND THE FINAL PLAT FOR THE FIRST PHASE OF HORIZON ESTATES, TRACT 3030, BEING A SUBDIVISION OF PARCEL 3, AS SHOWN ON RECORD OF SURVEY, BOOK 1, PAGE 35, A PORTION OF THE NORTH HALF OF SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The owner/developer is Joe D'Angelo, Bullhead City, Arizona. The latest contact agent for this project was John Finn of Cedar Creek Development, Lake Havasu City, Arizona, and WHEREAS, the property is located over nine miles west of the City of Kingman, and is accessed via State Highway 68, then north one-quarter mile on Teddy Roosevelt Road, then west one-half mile, and south of Chino Road to the site, and WHEREAS, the Preliminary Plan depicts approximately 40 acres subdivided into 220 condominium dwelling units, 52 duplex units, seven 16-unit apartment complexes and a 75,000-square-foot commercial center, to be served by an on-site wastewater treatment plant, and WHEREAS, the Preliminary Plan for Horizon Estates, Tract 3030, was approved by the Mohave County Board of Supervisors on February 4, 1991, per BOS Resolution No. 91-51. The rezoning of the property was conditionally approved on the same date, per BOS Resolution No. 91-76. The Final Plat for Tract 3030-A was approved on August 5, 1991, per BOS Resolution No. 91-212. The first Extension of Time of the approval of the Preliminary Plan was granted on March 8, 1993, per BOS Resolution No. 93-64, expiring on February 4, 1994. The developer failed to request an Extension of Time in 1994. in 1995 the developer requested a two-year extension to bring the subdivision approvals up to date. The second and third extensions of project approval were approved on March 10, 1995, per BOS Resolution No. 95-88. The Preliminary Plan approval for this tract expired automatically on February 4, 1996. The developer did not request a further Extension of Time for the approval of the project, and WHEREAS, the developer submitted a written request dated June 15, 1998, withdrawing Horizon Estates, Tract 3030, from processing, and consenting to the rescission of the approvals for the project, and RESOLUTION NO. 98-282 Page 2 WHEREAS, all resolutions, including BOS Resolution Nos. 91-331, 93-64, and 95-88 which require compliance with the conditions of the above-referenced rescinded approvals, are themselves voided. All notices have been advertised and posted according to regulations, and WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
