HomeMy WebLinkAbout98-286 OFFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAI~ MC CALL, MOHAVE COUNTY RECORDER 08/12/98 04:35P PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.~0 RESOLUTION NO. 98-286 A RESOLIJTION SETTING FORTH A REZONE OF A PORTION OF THE N¼ NW¼ OF SECTION 28, IN TOWNSHIP 20 NORTH, RANGE 15 WEST, FROM C-RE/5A (COMMERCIAL- RECREATION/FIVE ACRE MINIMUM LOT SIZE) AND R-E (RESIDENTIAL-RECREATION) ZONES TO C-RE/5A (COMMERCIAL-RECREATION/FIVE ACRE MINIMUM LOT SIZE) AND R-E/IA (RESIDENTIAL-RECREATION/ONE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COIdNTY GENERAL AREA, MOItAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Boaxd of Supervisors held on August 10, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Joseph R. and Sharon M. Davis, owners of the Hualapai Mountain Lodge, of Costa Mesa, California, and WHEREAS, this property is located south and east of Kingman approximately 12 miles on Hualapai Mountain Road. The site is accessed from Kingman via southeast on Hualapai Mountain Road to the site, located on the southwest side between Chrumb Road and Flag Mine Road. The property has the Hualapai Mountain Lodge, a motel, a general store, swimming pool, a recreational vehicle park, and several accessory buildings on it. The terrain is rolling mountains, generally sloping to the northeast. The surrounding land uses consist of single-family residences and vacant lots. The Hualapai Mountain Park is located to the south and north. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for the division of this property. The applicant proposes to divide the 18.14-acre parcel into one 8.1-acre parcel to be zoned C-RE/5A (Commercial-Recreation/Five Acre Minimum Lot Size) and four parcels, one 5.3-acres, one 2.04-acres, one 1.3-acres and one 1.01-acres, to be zoned R-E/lA (Residential-Recreation/One Acre Minimum Lot Size). This will make zoning fit the property as the current zoning does not agree with the present use of the proper~y. The Mohave County General Plan designates this area as a Rural Development Area and the Pine Lake area is considered an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-2507B indicates that the northern part of this parcel where the Wheeler Wash crosses from northwest to southwest is in Zone A, in the Special Flood Hazard Area; the remainder of the parcel described is in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, tiffs item was first scheduled for the Planning and Zoning Commission meeting on May 13, 1998, and was continued by the staff due to questions requiring a legal opinion from the County Attorney. In his memorandum dated May 26, 1998, Mr. Richard L. Basinger, Deputy County Attorney, stated that the rezone could be processed, and PAGE 2 OF 4 8K S14t F'G ~6 FEE'~SQO~510 RESOLUTION NO. 98-286 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, other than the noted Wheeler Wash crossing from northwest to southwest. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: 1. Parcel 1 will be rezoned C-RE/5A (Commercial-Recreation/Five Acre Minimum Lot Size), Parcel 2 will be rezoned R-E/4A (Residential-Recreation/Four Acre Minimum Lot Size) and Parcels 3, 4, and 5 will be R-E/IA (Residential-Recreation/One Acre Minimum Lot Size), as shown on Exhibit "A." 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. At the time of any additional development a Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. 6. The applicable flood zone(s) shall be noted on the Parcel Plat. 7. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective until at least 30 days after final Bom'd of Supervisors approval for the change in classification, as per ARS 11-829E. PAGE RESOLUTION NO. 98-286 Page 3 9. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Cormnission and outlined herein.
