MOHA~E (:OUNTY RECORDER 08/12/98 04:~6P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 98-287 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 93-87, FOR A REZONE OF A PORTION OF THE RICE BIRD MINING CLAIM IN THE SAN FRANCISCO MINING DISTRICT, IN SECTION 23, TOWNSHIP 19 NORTH, RANGE 20 WEST, TO DELETE THE REQUIREMENT FOR A PARCEL PLAT, IN THE OATMAN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10, 1998, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 93-87, setting forth a Rezone, should be granted for the above-described property as requested by Ellen DeLong of Oatman, Arizona, and WHEREAS, the language to be added has been bolded. Language to be deleted has been struck, and WHEREAS, this property is located within the Oatman Townsite on the west side of Old Highway 66 and is accessed from Old Highway 66 directly to the west. The property is hilly and has a house on it, being used as an art gallery. Them are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area and the Oatman Townsite is an Outlying Community, and WHEREAS, the applicant requests this Amendment to BOS Resolution No. 93-87, approving a Rezone, to delete the requirement for a Parcel Plat as stated in her letter dated June 1, 1998. The Mohave County Public Works Department, in their review of the site plan for the applicant's commercial operation, determined that the Parcel Plat is not required, and WHEREAS, a review of FEMA FIRM Panel #040058-2475B indicates the parcel described to be in Zone D, in a FEMA Unmapped Area. Recommendation: Do not build within the possible flood boundaries of any wash, and WHEREAS, the follo~ving described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recorrm~ended APPROVAL of the proposed Amendment to BOS Resolution No. 93-87, setting forth a Rezone, subject to the following: 1. Compliance w/th all applicable provisions of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. Prior to any modification to any buildings on the property, requisite Mohave County Permits must be obtained. b:. 3. If Old Highway 66 is a part of the Parcel Plat Right-of-Way, it will need to be dedicated. 6~ 4. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, and conditions contained herein. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED this Amendment to BOS Resolution No. 93-87, setting forth a Rezone, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
