HomeMy WebLinkAbout98-289 OFFICIAL RECORDS OF MOHAVE COUNTY, AZ 08/12/78 04:~7F' PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE C.rmO RESOLUTION NO. 98-289 A RESOLUTION SETTING FORTH A REZONE OF LOT 12, BLOCK AA, LAKE MOHAVE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, IN SECTION 31, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-I (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WItEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 10, 1998, a public hearing was conducted to detemfine whether approval should be granted to Rezone the above- described property as requested by Oneta B. Jackson of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road between Gordon Drive and Northern Avenue. The site is accessed from Stockton Hill Road, via east on Gordon Drive to North Lomita Street, then north on North Lomita Street to the site, located on the west side approximately 200 feet north of Gordon Drive. The property has a single-family residence and a garage on the north half of the lot. The south half is vacant and the terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of single-family residences, vacant lots, and the Desert Church of Christ to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to sell the south half of her property to the Desert Church o£Christ to allow for additional pat'king for the church. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: PAGE 2 OF 2 BK 314t P(i 445 FEE~9804~5!3 RESOLUTION ]NO. 98-289 Page 2 1. This property will be rezoned R-1/20M (Single Family Residential/Twenty Thousand Square Foot Minimun~ Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The Desert Church of Christ will have to pave the parking lot to Standard Specification 171 or better. A grading plan must be submitted and approved prior to approval of permits and before establishing the use. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
