HomeMy WebLinkAbout98-290 OFFICIAL RECORDS OF ~OH~VE COUNTY~ ~Z JO~N ~C C~LL~ ~OH~VE COUNTY RECORDER MOHAVE COUNI'Y BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 98-290 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 22, BLOCK 8, SHANGRI- LA ESTATES, SECOND AMENDED, IN SECTION 5, TOWNSHIP 21 NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board o£ Supervisors held on August 10, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Charles M. Ciangura, II, and Deborah M. Ciangura of Kingman, Arizona, and WHEREAS, this property is located northwest of State Highway 66 and north of Airway Avenue, north of the City of Kingman. The site is accessed from State Highway 66 via west on Airway Avenue to North Bank Street, then north on North Bank Street to KinG Avenue, then east on King Avenue to Evans Street, then north on Evans Street to the site, located on the east side approximately 850 £eet north o£ King Avenue. The property has a single-family residence, a 30-foot by 40-foot metal building, and a horse corral on it. The terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist o£ single-£amily residences and vacant lots. There are no significant dxainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow an 8-foot by 30-£oot travel trailer to be used as a secondary residence in an A-R (Agricultural-Residential) zone for Mrs. Ciangura's mother. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review o£ FEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the £ollowing described Findings of' Fact are for the above-captioned item: a. Alt notices have been advertised and posted according to regulations. h. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate £or the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: ~ ~l~i~l, Pd z~.~7 EEE~'~8 RESOLUTION NO. 98-290 Page 2 1. This Zoning Use Permit is fbr a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to th9 public health, safety, and welfare. 6. This Zoning Use Permit is approved for one year and expires August 10. 1999. Travel trailers allowed as secondary residences shall be approved by the Board of Supervisors in one-year increments following a reconunendation from the Planning and Zoning Commission. An application for an Extension of Time must be applied for. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 25, 1998, and posted on July 24, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 10, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
