EVALUATION OF A REQUEST FOR AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF SUNRISE VISTAS, TRACT 4108, BEING A
SUBDIVISION OF A PORTION OF SECTION 18, TOWNSHIP 19 NORTH, RANGE 21 WEST, IN
THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meefmg of the Mohave County Board of Supervisors held on September
8, 1998, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by Rafe Cohen, one of the development partners, Fort Mojave, Arizona, for the above-
described Preliminary Plan. The owners/developers of this tract are Vanderslice 80, Sherman Oaks,
California; B&R Development, Fort Mojave, Arizona; and Alexander/Catania Development, Inc., Azusa,
California. The project engineer is Mohave Engineering, Inc., Kingman, Arizona, and
WHEREAS, the property is located approximately one (1) mile southeast of Bullhead City and is
accessed via State Highway 95, then east two miles along Camp Mohave Road and north to the site, and
WHEREAS, the Preliminary Plan depicts 160 acres subdivided into 705 single-family residential
lots and a 2.21 -acre commercial parcel, and
WHEREAS, the owner/developer has indicated in a letter dated June 22, 1998, that an Extension
of Time is being requested in order to give the project engineer more time to prepare, submit and process
Final Plats for the several remaining phases of this subdivision. The most recently approved phasing plan
includes nine phases, four already recorded, five pending, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on July 23, 1990, per BOS Resolution No. 90-192. The first Extension of Time for the approval
of the Preliminary Plan was granted on November 2, 1992, per BOS Resolution No. 92-382. The approval
for the Preliminary Plan was amended on February 1, 1993, per BOS Resolution No. 93-32. The Final Plat
for Tract 4108-A was approved on April 5, 1993, per BOS Resolution No. 93-78. The Final Plats for Tracts
4108-B and 4108-C were approved on March 1, 1994, per BOS Resolution Nos. 94-66 and 94~67. BOS
Resolution No. 94-134, granted on May 2, 1994, served as the second and third extensions. The fourth and
fifth extensions were granted on April 1, 1996, per BOS Resolution No. 96-111. The Final Plats for Tracts
4108-D and 4108-E were approved on May 6, 1996, per BOS Resolution Nos. 96-170 and 96-171. BOS
Resolution Nos. 96-170 and 96-171 were amended respectively by BOS Resolution Nos. 96-405 and 96-
406, approved on December 2, 1996. The sixth extension was granted on August 4, 1997, per BOS
Resolution No. 97-265. Subdivision Regulations, Article 3.10-1, states: "Upon application to the

Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be
granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action
is not taken then all proceedings relating to the plat shall be terminated.", and
WHEREAS, the Final Plat for Sunrise Vistas, Tract 410S-A, was recorded on August 23, 1993. The
Final Plat for Tract 4108-B was recorded on July 1, 1994. The Final Plat for Tract 4108-C was recorded
on October 21, 1994. The Final Plat for Tract 4108-D was recorded on April 3, 1997. Improvements have
been completed for the first four phases of this subdivision, and all assurances released. The developers
contend that the real estate market is not currently conducive to the sales of mobile-home lots in unrecorded
Tract 4108-E, and have not submitted an assurance for that phase and have chosen to delay the recordation
of that Final Plat, while processing instead a Final Plat for Tract 4108-F, now in review, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will he reviewed. They have recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this action, if approved, will be the seventh Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request complies with the Extension of Time Policy due to the following: 1) A phase
of this subdivision has been recorded in the past two years; and 2) a Final Plat for another
phase of this' subdivision is currently in review, being actively processed.
c. Though a seventh Extension of Time is not usually anticipated under the Preliminary Plan
Extension of Time Policy, four out of nine phases of this subdivision have, since the initial
submittal of this project in March, 1990, been processed to recordation, and improvements
have been completed within those phases. Many residences have been constructed within
the recorded phases of this subdivision. The successful development of this project, though
taking many years to process, warrants an additional Extension of Time for the approval of
the tract Preliminary Plan.
WHEREAS, at the public heating before the Mohave Cotmty Planning and Zoning Commission on
August 12, 1998, the Conmfission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 90-192, 92-382, 93-32, 94-134, 96-
11 l, and 97-265.
2. This Extension of Time will be in effect until July 23, 1999.

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED this Extension of Time as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
