HomeMy WebLinkAbout98-311 RESOLUTION NO. 98-311 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1, LAGOON ESTATES, IN SECTION 35, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. VqItEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Doyle E. and Donna L. Chastain of Mohave Valley, Arizona, and WHEREAS, this property is located east of State Highway 95, between Willow Drive and Laguna Road. The site is accessed from State Highway 95 via east on Vista Drive to the site, located on the southwest comer of Vista Drive and Calle Del Media. The property has a single-family residence, several accessory buildings, and a park-model mobile home on it. The terrain is flat, sloping slightly to the west. The surrounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a 12-foot by 34-foot park model mobile home as a secondary residence, for parents, in anA-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WItEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazaxd Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-311 Page 2 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, enviromnental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. 6. This Zoning Use Pemfit is approved for one year and expires September 8, 1999. Travel Trailers and Park Model mobile homes are allowed as secondary residences and shall be approved by the Board of Supervisors in one-year increments, following a recommendation from the Planning and Zoning Commission. An application for an Extension of Time must be applied for. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave Coun~l~n~ing and Zoning Commission and outlined herein. . sx~'~g~llS0 ~ MO PERVISORS
