HomeMy WebLinkAbout98-312 RESOLUTION NO. 98-312 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 37, BLOCK 1, SUN VALLEY, TRACT 4064-B, IN SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A MODEL HOME/SALES OFFICE IN AN R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Glen A. Rajaniemi, owner of Mountain View Homes, Bullhead City, Arizona, and WHEREAS, this property is located east of State Highway 95, between Lipan Boulevard and Boundary Cone Road. The site is accessed from State Highway 95 via east on Lipan Boulevard to the site, located on the south side approximately 150 feet east of Kodiak East. The property has a single-family residence under construction on it and the terrain is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a model home/sales office in an R-O (Single Family Residential/Mobile Homes Prohibited) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. RESOLUTION NO. 98-312 Page 2 WHEREAS, at the public heaxing before the Mohave County Planning and Zoning Conunission on August 12, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a model home/sales office in an R-O (Single Family Residential/Mobile Homes Prohibited) zone and activities related thereto, including the selling of homes within the SUN VALLEY, Tract 4064, subdivision. No off-site sales will be allowed. 2. The house will be fully functional. When it is no longer being used as a sales office and model home, it will be reconfigured to a single-family residence with garage and will be inspected by the Mohave County Building Department for compliance with the building code. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Conunission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave Cour~,i~i~aiming and Zoning Commission and outlined herein. ~, ~~ _~{ ~ Jmes ai
