HomeMy WebLinkAbout98-314 RESOLUTION NO. 98-314 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-194, 91- 233, 92-64, AND 92-84, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN, REZONING, AMENDED REZONING AND REVISED PRELIMINARY PLAN FOR COLORADO RIVERERONT TERRACE II, TRACT 4135, BEING A SUBDIVISION OF A PORTION OF SECTION 23, TOWNSHIP 17 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1998, a public hearing was conducted to determine whether the approvals for the above-described project should be rescinded. The o~vner/developer is Frank Curcio, Mohave Valley, Arizona. Project engineers of record have included Civiltec Engineering, Inc., Monrovia, California; Mohave Engineering Associates, Inc., Kingman, Arizona; and most recently Gilbertson Associates, Inc., Scottsdale, Arizona, and WHEREAS, the property is located adjacent to the Colorado River, approximately 13 miles south of Bullhead City. The site is accessed via State Highway 95, then south along Riverfront Parkway, and WItEREAS, the Preliminary Plan depicts about four and one-half acres subdivided into 22 single- family residential lots and two landscaping parcels. The minimum residential lot size was 6,000 square feet, and WHEREAS, the Preliminary Plan for Colorado Riverfront Terrace II, Tract 4135, was approved by the Mohave County Board of Supervisors on July 22, 1991, per BOS Resolution No. 91-194. A revised Preliminary Plan was approved on March 9, 1992, per BOS Resolution No. 92-64. BOS Resolution No. 91- 233 was amended on March 9, 1992, per BOS Resolution No. 92-84. BOS Resolution No. 95-127, granted on April 3, 1995, served as the first and second Extensions of Time for the approval of the Prelinfinary Plan. The third extension was granted on April 1, 1996, per BOS Resolution No. 96-113. The Preliminary Plan approval for this tract expired automatically on March 9, 1997. The developer did not request a further Extension of Time for the approval of the project, and WHEREAS, the rezoning of the property, from R-E to R-O, was conditionally approved on September 3, 1991, per BOS Resolution No. 91-233, and WHEREAS, the developer has in the past year discussed with staff a possible future new subdivision proposal which may encompass the property in three expired subdivisions, including Tract 4139, Tract 4151 and this project, Colorado Riverfront Terrace II, Tract 4135. Mr. Curcio has expressed his consent to rescind these already-terminated subdivisions to make way for any new proposal he may submit, and RESOLUTION NO. 98-314 Page 2 WHEREAS, all resolutions including BOS Resolution Nos. 95-127 and 96-113, which required compliance with the conditions of the above-referenced rescinded approvals, are themselves voided. All notices have been advertised and posted according to regulations, and WItEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1998, the Commission reconm~ended APPROVAL of the rescission of this subdivision, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1998, APPROVED the rescission of this subdivision as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
