A RESOLUTION SETTING FORTH A RESCISSION OF P&ZC RESOLUTION NO. 89-3, AND
BOS RESOLUTION NOS. 92-29, 92-63 (AND AS AMENDED), AND 92-101, WHICH
CONDITIONALLY APPROVED THE PRELIMINARY PLAN, REZONINGS, AND
ABANDONMENT OF ROADWAY RIGHT-OF-WAY, FOR THE COVES AT RIVER TERRACE,
TRACT 4139, BEING A SUBDIVISION OF A PORTION OF SECTIONS 22 AND 23, TOWNSHIP
17 NORTH, RANGE 22 WEST, IN THE SOUTH MOItAVE VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
8, 1998, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. This evaluation is to determine whether the conditional approvals for the above-
described project should be rescinded. The owner/developer is Frank Curcio, Mohave Valley, Arizona. The
project engineer is Gilbertson Associates, Inc., Scottsdale, Arizona, and
WHEREAS, the property is located near the Colorado River, approximately 13 miles south of
Bullhead City. The site is accessed via State Highway 95, and south of Courtwright Road, along Riverfront
Parkway, and
WHEREAS, the Special Development Preliminary Plan depicts 186 acres subdivided into 586
single-family residential lots, multi-family and commercial elements, and many man-made inlets from the
Colorado River. Single-family residential lots were to have a minimum lot size of 6,000 square feet, and
multi-family residential lots were to have a minimum lot size of 3,000 square feet, and
WHEREAS, the Preliminary Plan for The Coves at River Terrace, Tract 4139, was approved by the
Mohave County Board of Supervisors on March 9, 1992, per BOS Resolution No. 92-63. An abandonment
of roadway right-of-way in the way of the subdivision design had previously been approved on February
3, 1992, per BOS Resolution No. 92-29. BOS Resolution No. 92-63, the original Preliminary Plan approval,
was amended on April 6, 1992. BOS Resolution No. 95-128, granted on April 3, 1995, served as the first
and second Extensions of Time for the approval of the Preliminary Plan. The third extension was granted
on April 1, 1996, per BOS Resolution No. 96-112. The Preliminary Plan approval for this tract expired
automatically on March 9, 1997. The developer did not request a further Extension of Time for the approval
of the project, and
WHEREAS, the property was rezoned from R-E to R-MH, conditionally approved on January 11,
1989, per P&ZC Resolution No. 89-3; and from R-E to (S-D)R-O/6M, R/3M, C/4A, and C-RE,
conditionally approved on April 6, 1992, per BOS Resolution No. 92-101, and

WHEREAS, the developer has in the past year discussed with staff a possible future new
subdivision proposal which may encompass the property in three expired subdivisions, including Tract 4135,
Tract 4151 and this project, The Coves at River Terrace, Tract 4139. Mr. Curcio has expressed his consent
to rescind these already-terminated subdivisions to make way for any new proposal he may submit, and
WHEREAS, all resolutions including BOS Resolution Nos. 95-128 and 96-i 12, which required
compliance with the conditions of the above-referenced rescinded approvals, are themselves voided. Ail
notices have been advertised and posted according to regulations, and
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
August 12, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED the rescission of this subdivision as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
