HomeMy WebLinkAbout98-316 RESOLUTION NO. 98-316 A RESOLUTION SETTING FORTH AN ABANDONMENT AND REVERSION TO ACREAGE OF ASSESSOR'S PARCELS 225-59-003 AND 225-59-004, AS SHOWN ON THE FEBRUARY 24, 1998, REVISED MOHAVE COUNTY TAX ASSESSOR'S MAP, IN A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, this evaluation is to determine whether approval should be granted to Abandon and Revert to Acreage the above-described property, as requested by Sterling Vamer, representing 1043 Arizona Property, L.L.C., of Mission Viejo, California, and WHEREAS, this property is located east of State Highway 95, between Boundary Cone Road and Lipan Boulevard. The site is accessed from State Highway 95 via east on Boundary Cone Road to the site, located on the north side of Boundary Cone Road, extending for nearly one mile between Mountain View Road and County Route 282, aka Vanderslice Road, aka Bison Road. The property contains approximately 260 acres. The surrounding land uses consist of vacant land, with the Los Lagos and Sun Valley subdivisions to the north, and WHEREAS, the applicant requests the Abandonment and Reversion to Acreage of these two parcels to allow for the creation of Los Lagos Country Club Villas and Estates, Tract 4166, a 628-1ot subdivision, with an 18-hole golf course and restaurant, and WHEREAS, the Mohave County Department of Public Works does not object to the Abandonment and Reversion to Acreage if done concurrently with the recordation of Tract 4166, and WHEREAS, Mohave Electric Cooperative, Citizens Utilities Rural Co., Southwest Gas, and various cable television providers have reviewed the owner's petition and have no objection to the parcels being abandoned and reverted to acreage, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 98-316 Page 2 c. The site is adequate for the action intended. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1998, the Commission recommended APPROVAL for the Abandonment and Reversion to Acreage subject to the following: 1. The Abandonment will be effective upon the recordation of the Final Plat of Los Lagos Country Club Villas and Estates, Tract 4166. 2. Written concurrence will be submitted from all affected utility companies. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 22, I998, and August 29, 1998, and posted August 21, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1998, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined heroin.
