A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 98-167
SETTING FORTH A REZONE OF THE W~ SE¼ SW¼ OF SECTION 26, TOWNSHIP 21 NORTH,
RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE
MINIMUM LOT SIZE) ZONE TO A-R/15A (AGRICULTURAL-RESIDENTIAL/FIFTEEN ACRE
MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
8, 1998, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 98-
167, setting forth a Rezone, should be granted for the above-described property as requested by William C.
and Amaa B. Hamilton of Golden Valley, Arizona, and
WItEREAS, the language to be added has been bolded. Language to be deleted has been ~trdck,
and
WHEREAS, this property is located south of State Highway 68 between Estrella Road and Laguna
Road. The site is accessed from State Highway 68 via south on Estrella Road to Unkar Drive, then east on
Unkar Drive approximately one-quarter mile to the property, which is located on the north side of Unkar
Drive. The property has a single-family residence on it, is relatively flat, and slopes slightly toward the
southeast. The surrounding land uses consist of vacant parcels and a few widely scattered single-family
residences. There are no significant drainage patterns, and
WHEREAS, the applicants request this Amendment to BOS Resolution No. 98-167, approving
a Rezone, to delete the requirement for a Parcel Plat as the property was already split by Record of
Survey, Book 15, Page 64, recorded August 14, 1997, and is shown on the Mohave County Assessor's
map. The applicant is not splitting this approximately 20-gross-acre parcel, but requests this zone
change to be in compliance and to allow for the placement of a single-family residence on this
property, and
WHEREAS, the Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area. Additional comments from Mohave County Floodplain: A
plot plan is needed, as a portion of the parcel is in Zone C, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the
Sacramento Valley/Golden Valley Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
£. There are no significant environmental features affecting the site, except the Special Flood
Hazard Area noted above.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 12, 1998, the Commission recommended APPROVAL for an Amendment to BOS Resolution No.
98-167, setting forth a Rezone, subject to the following:
1. This parcel will be rezoned A-R/15A (Agricultural-Residential/Fifteen Acre Minimum Lot
Size).
~ 2. That a 42-foot road right-of-way adjacent to the south property line, to be known as Unkar
Drive, shall be dedicated to the public and accepted by the Mohave County Board of
Supervisors. This may be accomplished via separate instrument.
4:. 3. The eight feet adjoining all rights-of-way shall be granted to the public as a Public Utility
Easement (PUE). This may be accomplished via separate instrument.
9:. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained

10.5. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.

will be void. If at the expiration of this period the property has not been improved to
meet the use for which it was conditionally approved, the Board of Supervisors (after
notification by registered mail to the owner and applicant who requested the rezoning) shall
schedule a public hearing to grant an extension, determine compliance with the schedule for
development, or cause the property to revert to its former zoning classification. This action
is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED this Amendment to BOS Resolution No. 98-167, setting forth
a Rezone, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
