A RESOLUTION SETTING FORTH A RESCISSION OF P&ZC RESOLUTION NOS. 89-179 AND
89-180, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING
FOR WALNUT CREEK COMMERCIAL, TRACT 3022, BEING A SUBDIVISION OF LOTS 1
AND 2, BLOCK 2, OF WALNUT CREEK ESTATES, UNIT I, TRACT 3007, A PORTION OF
SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, IN THE GOLDEN VALLEY AREA,
MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
8, 1998, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. The owner/developer is Walnut Creek Development, Kingman, Arizona. The project
engineer was Denise Burton, Las Vegas, Nevada, and
WHEREAS, the property is located approximately four (4) miles southwest of the City of Kingman.
The site is accessed via Interstate 40, then southwest one (1) mile from the McConnico Interchange, south
of and along Oatman Road, and
WHEREAS, the Preliminary Plan depicts 6.59 acres subdivided into six commercial lots, and
WHEREAS, the Preliminary Plan for Walnut Creek Commercial, Tract 3022, was approved by the
Mohave County Board of Supervisors on August 9, 1989, per P&ZC Resolution No. 89-179. The first
Extension of Time for the approval of the Preliminary Plan was granted on October 5, 1992, per BOS
Resolution No. 92-324. The second extension was granted on February 1, 1993, per BOS Resolution No.
93-48. The third extension was granted on January 3, 1994, per BOS Resolution No. 94-22. The fourth
extension was granted on February 6, 1995, per BOS Resolution No. 95-50. The fifth extension was granted
on January 2, 1996, per BOS Resolution No. 96-29. The sixth extension was granted on February 3, 1997,
per BOS Resolution 97-44. The Preliminary Plan approval for this tract expired automatically on January
3, 1998. The developer did not request a further Extension of Time for the approval of the project, and
WHEREAS, the rezoning of the property, from A-R/3A to C-2, was conditionally approved on
August 9, 1989, per P&ZC Resolution No. 89-180, and
WHEREAS, the developer submitted a letter dated June 8, 1998, indicating that the owner no longer
intends to subdivide this property, and expressing consent to the rescission of the approvals for the
subdivsion, and

WHEREAS, all resolutions including BOS Resolution Nos. 92-324, 93-48, 94-22, 95-50, 96-29,
and 97-44, which required compliance with the conditions of the above-referenced rescinded approvals, are
themselves voided. All notices have been advertised and posted according to regulations, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 12, 1998, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED the rescission of this subdivision as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
