S1P PAGE 1 {3F ~OH~VR COUHTY BOARD OF RECORDIN6 FEE m).OO RESOLUTION NO. 98-326 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THAT PORTION OF LOT 74, LYING WESTERLY OF US HIGHWAY 93, IN GATEWAY ACRES, TRACT 10, IN SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM A (GENERAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by William J. and Carolyn Sue Jones of Kingman, Arizona, and WHEREAS, this property is located on the west side of US Highway 93, approximately one-half mile north of Pierce Ferry Road. The site is accessed to the west directly from US Highway 93. A tourist souvenir shop/deli is located on the property. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on October 16, 1995, via BOS Resolution No. 95-371. It was extended for the first and second time with BOS Resolution No. 97-430 on December 1, 1997, and WHEREAS, it appears that the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 95-371, and WHEREAS, this will be the third Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request DOES NOT comply with the Extension of Time Policy. PAGE 2 OF' 2 BK 3157 PG 165 FEE'~98~.~54462 RESOLUTION NO. 98-326 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1998, the Commission recommended DENIAL for an Extension of Time for a Rezone based upon the following: 1. The applicant has not accomplished any of the conditions of BOS Resolution No. 95-371, dated October 16, 1995. 2. This resolution will be scheduled for rescission at the next Planning and Zoning Conmxission meeting. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1998, DENIED this Extension of Time for a Rezone as recommended by the Mohave County Planning mad Zoning Commission and outlined herein.
