A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF PARCEL 28,
CEDAR HILLS RANCHES, UNIT 2, IN SECTION 31, TOWNSHIP 21 NORTH, RANGE 14 WEST,
FOR A SECONDARY RESIDENCE IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN
ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAYE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meet'rog of the Mohave County Board of Supervisors held on September
8, 1998, a public heating was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Frank E. and Charlene D. Proa of Kingman, Arizona, and
WHEREAS, this property is located south of Interstate 40, between Blake Ranch Road and Arabian
Drive. The site is accessed ~om Interstate 40 via southwest at the Blake Ranch Road exit to the site, located
on the southeast side approximately one and one-half miles from Interstate 40. The property has a single-
family residence, along with several accessory buildings on it, and the terrain is rolling hills, sloping
generally to the southeast. The surrounding land uses consist of vacant lots and a few scattered single-
family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Pemfit to allow a secondary residence, for
mother-in-law quarters, in an A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone. The
Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 12, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a secondary residence on this property and the activities
related thereto. The floor area of the secondary residence shall comply with the size
requirements in Section 27.R (Accessory or Secondary Residence Requirements).
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site
plan in accordance with Section 27.R must be completed and approved prior to approval of
permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not conunenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WltEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 22, 1998, and posted on August 21, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 8, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
