INDEXED OFFICIAL RE~ORDS OF MOHAVE COUN'IY~ AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 10/07/1~8 02:2~P PAGE 1 OF 2 ~iOHAVE COUNTY BOARO OF SUPERVISORS RECORQINa FEE 0.00 RESOLUTION NO. 98-340 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 96-140 WHICH APPROVED THE REZONE FOR THE NORTHERLY 329.75 FEET OF THE SW¼ NE¼ OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of BOS Resolution No. 96-140, for the Rezone for the above-described property, as requested by Carl V. and Sheila Massegee of Henderson, Nevada, and WHEREAS, this property is located south of Interstate 15 and east of the Littlefield Interchange. The site is accessed from Interstate 15 via Farm Road Exit 9 to the hrterstate 15 frontage road, then northeast on the frontage road to a 60-foot Ingress and Egress (I&E)-easement located approximately three-quarter mile northeast of Exit 9, then east on the I&E approximately 400 feet to the site. The property is vacant and relatively flat, sloping slightly to the north. The surrounding land uses consist of vacant property and a few scattered residences. There are no significant drainage patterns crossing the property, and WHEREAS, this property was conditionally approved for a rezone to SD/C-2 (Special Development/General Commercial) by the Mohave County Board of Supervisors on May 6, 1996, via BOS Resolution No. 96-140. It has not been extended. In their letter dated July 15, 1998, the property owner requested that the rezoning be rescinded due to unforseen engineering problems over the last two years. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended that BOS Resolution No. 96-140 be RESCINDED and the zoning to REVERT to A-R (Agricultural-Residential). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, i998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
