WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Carl V. and Sheila Massegee of Henderson, Nevada, and WHEREAS, this property is located south of Interstate 15 and east of the Littlefield Interchange. The site is accessed from Interstate 15 via Farm Road Exit 9 to the Interstate 15 frontage road, then northeast on the frontage road to a 60-foot Ingress and Egress (I&E) easement located approximately three-quarter mile northeast of Exit 9, then east on the I&E approximately 400 feet to the site. The property has two mobile homes on it and is relatively flat, sloping slightly to the north. The surrounding land uses consist of vacant property and a few scattered residences. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area and the Virgin River Communities Area Plan designates the ;vestem portion of this area as Commercial (C-2 [General Commercial] and C-2H [General Connnercial Highway Frontage]) zoning and the eastern portion as Low Density Residential (one to five dwelling units per acre), and WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the Special Flood Hazard Area, noted above PAGE 2 OF= ~ BK 3i73 F'G ,~72 FEE:~98060601 RESOLUTION NO. 98-341 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). Per the Zoning Ordinance, the secondary residence will be used for non-paying guests and relatives only. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
