HomeMy WebLinkAbout98-343 iNDEXED 980606c~3 BK 3173 P6 375 OFFICIAL RECORDS OF MOHAVE COUNTY~ JOAN MC (:ALL~ MOHAVE COUNTY RECORDER. 1-1/?/1998 '2:3~F' PAGE HOHAVE COUNTY 80ARB OF SUPERVISORS RECORDING FEE RESOLUTION NO. 98-343 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF FAIRWAY VILLAGE, TRACT 4154, BEING A SUBDIVISION OF GOVERNMENT LOT 2 AND A PORTION OF GOVERNMENT LOT 1, SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public heating was conducted to determine whether approval should be granted for an Extension of Time as requested by the owner/developer and project engineer Glen Ludwig of Ludwig Engineering, Inc., San Bernardino, California, and WHEREAS, the property is located approximately four miles south of Bullhead City. The property is accessed via State Highway 95, immediately south of Lipan Boulevard and west one-tenth of a mile to the site, and WHEREAS, the Preliminary Plan depicts 70 acres subdivided into 357 single-family residential lots, and one common parcel containing 3.20 acres. The minimum residential lot size is 4,800 square feet. The average residential lot size is 5,715 square feet, and WHEREAS, the owner/developer has indicated in a letter dated August 3, 1998, that an Extension of Time is being requested so that the developer can continue to wait for the California economy to improve, spurring the market for improved-lot sales in the South Mohave Valley, at which time the developer intends to process the Final Plats for this subdivision, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on October 2, I995, per BOS Resolution No. 95-404. The first Extension of Time for the approval of the Preliminary Plan was granted on January 5, 1998, per BOS Resolution No. 98-3. Subdivision Regulation, Article 3.10-1, states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WltEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and PAGE 2 OF 3 8K ~i7~ I:'G ~76 FEE~9806060S RESOLUTION NO. 98-343 Page 2 WHEREAS, this action, if approved, will be the second Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request does not appear to comply with the Extension of Time Policy in that the policy states "nornrally, a maximum of a one (1) year extension will be granted for 'adverse economic conditions'." This is the second extension based on such a request. The developer claims that the Final Plat for the first phase of this subdivision has been prepared for some time, and contends that the real estate market is still too weak to absorb the product offered by this proposed subdivision, and acknowledges that for that reason the Final Plat(s) has not submitted for review. c. The Preliminary Plan Extension of Time Policy also states "If there has been no activity on the subdivision for three (3) years, the Planning and Zoning Department will recommend denial of the Extension of Time." No plats, improvement plans or any other documentation has been submitted since October, 1995 for review. The developer offered in his request letter dated August 3, 1998 to submit the Final Plat and improvement plans as evidence that the work had been completed, but the developer has confirmed that unless forced to do so, he does not intend at this time to have a Final Plat processed. d. A staff recommendation of approval for this request is being made in that other subdivisions under similar circumstances have in the recent past been granted a second Extension of Time. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 95-404 and 98-3. 2. Unless significant progress (including the submittal of a Final Plat for the first phase of this subdivision) is made in the coming year toward the recordation of this project, this will be the last Extension of Time for the ?reliminary Plan approval of Fairway Village, Tract 4154. 3. This Extension of Time will be in effect until October 2, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. PAGE 3 OF 3 8K 3:[73 PG 377 FEE$98;616[~ RESOLUTION NO. 98-343 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
