'~':/,~ MOHAVE COUNTY BOARD OF SUPERV]:SORS ~"~ RECORDING FEE 0.00 RESOLUTION NO. 98-347 A RESOLUTION SETTING FORTH AN ABANDONMENT AND REVERSION TO ACREAGE OF A PORTION OF PARCEL K-K, SERVING AS A PUBLIC UTILITY, DRAINAGE AND GOLF COURSE EASEMENT, IN DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-B, IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether approval should be granted to Abandon and Revert to Acreage the above-described property as requested by Sterling Varner, representing 1043 Arizona Property, L.L.C., of Mission Viejo, California, and WHEREAS, this property is located east of State Highway 95, between Joy Lane and Lipan Boulevard. The site is accessed from State Highway 95 via east on Lipan Boulevard to the site, located on the north side at the northwest corner of Lipan Boulevard and Lipan Court. The property is along the southern edge of the Desert Lakes Golf Course. The surrounding land uses consist of vacant land to the south, the Desert Lakes Golf Course and Estates subdivision to the north and east, and a decorative stone yard to the west. The western 80 feet of the parcel is within a wash, and WHEREAS, the applicant requests this Abandomnent and Reversion to Acreage of a portion of Parcel K-K to increase the size of Parcel V-V, which in turn will be subdivided for the residential development of Desert Lakes Golf Course and Estates, Unit E, Tract 4163, and WHEREAS, the Mohave County Public Works Department does not object to the Abandonment and Reversion to Acreage if done concurrently with the recordation of Tract 4163, and WHEREAS, Citizens Utilities Company, Southwest Gas, and various cable television providers have reviewed the owner's petition and have no objection to the lots being abandoned and reverted to acreage. Mohave Electric Cooperative objects to the abandonment due to the possible future need for an emergency feed, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 98-347 Page 2 c. The site is adequate for the action intended. d. The western 80 feet of the parcel is within a wash. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1998, the Commission recommended APPROVAL for the Abandonment and Reversion to Acreage subject to the following: 1. The Ai~andonment and Reversion to Acreage will be effective upon the recordation of the Final Plat of Desert Lakes Golf Course and Estates, Unit E, Tract 4163. 2. Written concurrence will be submitted from all affected utility companies. 3. That portion of Parcel K-K to be abandoned will conform to Exhibit "A." WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, September 19, 1998, and September 26, 1998, and posted September I8, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Abandonment and Reversion to Acreage as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
