RESOLUTION NO. 98-353
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 14, 15 AND 16, BLOCK
1, DESERT LAKES GOLF COURSE AND ESTATES, UNIT F, TRACT 4132, IN SECTION 35,
TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR THREE MODEL HOMES AND A SALES
OFFICE IN AN SD/R-O/6M (SPECIAL DEVELOPMENT/SINGLE FAMILY RESIDENTIAL/
MOBILE HOMES PROHIBITED/SIX THOUSAND SQUARE FOOT MINIMUM LOT SIZE)
ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
fire above-described property as requested by Sterling Vamer, Project Manager, representing 1043 Arizona
Properties, LLC, of Phoenix, Arizona, and
WHEREAS, this 13roperty is located east of State Highway 95, between Joy Lane and Lipan
Boulevard. The site is accessed from State Highway 95 via east on Joy Lane to Club House Drive, then
south on Club House Drive to Club House Way, then west on Club House Way approximately 100 feet to
the site, located on the north side. The property has three houses under construction that are nearing
completion and the lots are flat, sloping slightly to the west toward the Colorado River. The surrounding
land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for three model homes and a sales office
in an SD/R-O/6M (Special Development/Single Family Residential/Mobile Homes Prohibited/Six Thousand
Square Foot Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies ~vith the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses to the east similar to the above-proposed
action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for three model homes and a sales office in an SD/R-O/6M
(Special Development/Single Family Residential/Mobile Homes Prohibited/Six Thousand
Square Foot Minimum Lot Size) zone and activities related thereto, including the selling of
homes within the DESERT LAKES GOLF COURSE and ESTATES, Unit F, Tract 4132
subdivision. No off-site sales will be allowed.
2. The houses will remain fully functional. When they are no longer being used as a sales
office and model homes, each house will be re¢onfigured to a single-family residence with
garage and will be inspected by the Mohave County Building Department for compliance
with the building code.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
cimulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
1998, APPROVED this Zoning Use Permit as recommended by the Mohave County
Conunission and outlined herein.
