JOAN MC CALL, MOHAVE COUNTY RECORDER .-t,,.~/,~ 10/07/1998 U~.4~F'~" ~ ' PAGE 1 OF RECORDING FEE O.)fl RESOLUTION NO. 98-358 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE AND POSSIBLE REVERSION TO PREVIOUS ZONING OF A PORTION OF PARCEL 12 AS SHOWN ON PARCEL PLAT SILVERADO ESTATES, IN BOOK 2, PAGE 91, IN A PORTION OF THE E¼ SW¼ OF SECTION 5, TOWNSHIP 20 NORTH, RANGE 13 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Leo A. Horner, President, Silver Ranch Corporation of Kingman, Arizona, and WHEREAS, this property is located south of Interstate 40 and west of US Highway 93, approximately one mile south of the Interstate 40 and US Highway 93 intersection. The site is accessed from US Highway 93 and is on the southeast corner of the US Highway 93 and Crazy Horse Road intersection. The property is vacant and has rolling, hilly terrain, rising moderately toward the south. Them are no significant drainage pattems. The surrounding property is vacant. The Mohave County General Plan designates this area as a Suburban Development Area, and YvltEREAS, the rezone from A-R/10A (Agricultural-Resident/al/Ten Acre Minimum Lot Size) zone to C-2H (General Commercial Highway Frontage) zone was conditionally approved by the Mohave County Board of Supervisors on July 5, 1995, via BOS Resolution No. 95-302. It was extended for the first time with BOS Resolution No. 96-381 on November 4, 1996. A second extension was granted on November 3, 1997, with BOS Resolution No. 97-396, and WHEREAS, the applicant requests this Extension of Time because he has been devoting all his time to getting the final approval for his subdivision and has not been able to spend any time developing this property. This extension is to allow him time to complete the conditions of approval as required by BOS Resolution Nos. 95-302, 96-381, and 97-396, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 95-302, and WHEREAS, this will be the third Extension of Time for this property, and RESOLUTION NO. 98-358 Page 2 WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request DOES NOT comply with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 95-302. 2. This Extension of Time will be in effect until July 5, 1999. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions of BOS Resolution No. 95-302. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
