WHE~AS, at the regular meeting of the Mohave County Board og Supe~isors held on October
5, 1998, a public hearing was conducted to determine whether approval should be grated to Rezone the
above-described property as requested by Susan L. Mueller, Trustee of the La~el Wreath Living Trust,
Chloride, Arizona, and
~AS, this pmpe~ is located no,east of the inmrsection of U.S. Highway 93 ~d Mineral
P~k Road. The site is accessed from U.S. Highway 93 via no~heastefly on Mineral Pink Road to the Old
Highway to Boulder Dm, then no~hwesterly on the Old Highway to Boulder Dm approximately one and
one-q~er miles to ~ ~amed I&E, ~en east on ~e I&E approximately one-queer mile to ~e no~hwest
comer of~e property. The prope~y is vacant ~d the te~n is relatively flat, sloping slightly toward the
southwest. The s~ounding land uses consist of vacant parcels ~d a few widely sca~ered single-fmily
residences. Them are no signific~t drainage patterns, ~d
WHE~AS, the applic~t requests this zone ch~ge to ~low for ~e development. ~e applic~t
proposes to divide ~e 30-acre parcel into five approximately 6-gross-acre pamels. The Mohave County
Gener~ PI~ designates tNs area as a Rural Development Area, ~d
WHE~AS, a review of FEMA FI~ P~el ~040058-2150B indicates the parcel described to be
in Zone A, in the Special Flood Hazed Area, ~d
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been adve~ised ~d posted according to regulations.
b. The proposed action ~d effect complies with the Mohave County General PI~.
c. The site is adequate for the action intended ~d the use is consistent with the s~ounding
l~d uses and te=~n.
d. The neighboring ~ea contains l~d uses simil~ to the above-proposed action.
e. The site has legal access.
f. ~em me no sigNfic~t enviroment~ rear,es affecting the site, except ~e Special Flood
Hazard Area noted above.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 9, 1998, the Commission recommended APPROVAL for a Rezone subject to the following:
1. These parcels will be rezoned A-R/6A (Agricultural-Residential/Six Acre Minimum Parcel
Size). No more than four parcels will be created, as an adjacent parcel is also owned by the
applicant.
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The 30 feet along the north boundary of the property shall be granted to the public as an
Ingress and Egress (I&E).
4. All public easements granted on the Parcel Plat will be accepted by the Board of Supervisors
upon Parcel Plat recordation.
5. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. Each parcel shall have legal access.
7. The applicable flood zone(s) shall be noted on the Parcel Plat.
8. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
9. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS i 1-829E.
10. If the required parcel plat prepared in accordance ~vith Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded wittfin one year of Board of Supervisors approval, this rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted September 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 5, 1998, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
